Karlyn Bowman and the good people at AEI tell us that a majority of Americans now support the idea of gay marriage. Be that as it may, this has important implication for the gay marriage case now before the Supreme Court. The gay rights lobby adopted a litigation strategy only after they had failed to persuade voters (including people in California!) to support gay marriages. If we can’t get the American people to come along with us, they thought, then let’s do it through a lawsuit. But if most Americans now support gay marriage, there is little need for the Supreme Court to step into the debate. There are also a good many reasons for it not to do so, notably the way in which such a decision might be fodder for the anti-clerical left and its poisonous cultural wars.
