Our own Rich Lizardo predicts that gay marriage will be legal nationwide in the next two years, vindicating Justice Antonin Scalia. A daring prediction, but shy of the mark by three years, at least according to gay activists.
Molly Ball reports at The Atlantic:
Chad Griffin, president of the Human Rights Campaign, set an ambitious goal for the gay-marriage movement. “Within five years, together, we will bring marriage equality to all 50 states.”
Just as Justice Scalia wrote in his dissenting opinion, Kennedy’s majority opinion was essentially a “lecture on how superior the majority’s moral judgment in favor of same-sex marriage is to the Congress’s hateful moral judgment against it.” Aligned with this judicial ruling, litigators are dipping into their ink wells.
David Boies, a lawyer who argued against Prop 8, said in a conference call that the court “held that there was no rational basis, no legitimate justification, for discrimination against gay and lesbian citizens,” and therefore subjected every gay marriage prohibition in the states to legal challenge.
Five years? My bet was two as well, but that’s a worst-case scenario. At least we still have a few years to write legislation protecting churches and private business from discrimination litigation, as Ross Douthat emphasizes.
The question is: What will radical homosexuals do after gay marriage is legal in every state? They’ll start targeting any institution that opposes using sex as one’s primary identity; they’ll aim for the church, the mosque, and the temple.
