WASHINGTON — I do not know what the learned political
scientists of the Republic say about it, but it seems to me that
the laws of the land are now so poorly written that almost no one
knows what they mean. That is a government bureaucrat’s
delight!
The healthcare bill, commonly known disparagingly as
Obamacare, is typical. No member of Congress could have read it
before voting on it, and even now I doubt any congressperson has
read it through. I know someone who did read it through but he is
an insomniac and does not count. Then there is Betsy McCaughey,
former Lieutenant Governor of New York. She read it through, but
only because she thought it an atrocity and wanted to protect
Americans from it.
Finally, someone over at Health and Human Services at
least read what it said about long-term health care and the
authorities there made a surprising admission: It is unworkable and
possibly illegal. HHS said Friday that it would not be implemented.
It would have been nice if they had admitted that the whole bill
was unworkable before all the Democrats clapped their hands and
voted it into law back in March of last year. The law does not
control health costs. It will ration healthcare. And it
ruins the vast majority of Americans’ health insurance policies,
while lumping us all into that characteristic product of the Obama
Administration, chaos.
Then over the weekend we are told President Barack Obama
broke from campaigning and took an interest in what his government
is doing. Now he is for the section of his healthcare bill that his
HHS Department told us Friday was defunct, the long-care health
provision. He is waiting for the Republicans to vote it down, and
he will veto their work. So we are now told. As I said, the
resulting product of Obama is chaos!
It seems to me that this tendency to pass laws that are
inscrutable is a growing problem for the Republic, but it is not
unintended. The progressives and Liberals favor these abstruse
laws. It is their intention to confuse the public. They intend that
the laws are so convoluted, complicated, and, in the end,
soporific, that the electorate will eventually go away with a
headache.
Herbert Croly, one of the founding fathers of the
progressive movement — read Liberal movement — wrote in 1909 in
his groundbreaking book The Promise of American Life, “To
be sure, any increase in centralized power and responsibility,
expedient or inexpedient, is injurious to certain aspects of
traditional American democracy. But the fault in that case lies
with the democratic tradition; and the erroneous and misleading
tradition must yield before the march of constructive national
democracy. The national advance will always be impeded by these
misleading and erroneous ideas, and, what is more, it always should
be impeded by them, because at bottom ideas of this kind are merely
an expression of the fact that the average American individual
is morally and intellectually inadequate to a serious and
consistent conception of his responsibilities as a democrat”
(emphasis added).
The origins of Liberalism were always undemocratic. Now
the Liberals are ever bolder in their pronouncements. Peter Orszag,
formerly with the Obama administration before the chaos became too
much for him, just penned an article in the New Republic
titled, “Too Much of a Good Thing: Why We Need less Democracy” —
and by the way the New Republic was founded by Herbert
Croly. Beverly Perdue, the governor of North Carolina, said
publicly, “I think we ought to suspend, perhaps, elections and just
tell them we won’t hold it against them, whatever decisions they
make, to just let them help this country recover.” The “they” here
are our representatives in Congress.
Those are the sentiments of people with little faith in
democracy. They want laws written that are inscrutable and they
will leave it to the bureaucrats to interpret them in ways that
favor the state and the zeitgeist. Thankfully we have the
Constitution and the Tea Party.

There are no Americans fighting for it. Everyone is screaming to let the Republicans get control next year and they will fix it. Will they? Last time they had control we had such glorious and unconstitutional things occur such as running large budget deficits, Medicare D, No Child Left Behind, failed to secure the border and not only did they not attempt to deal with the illegals in this country, they were going to try and get an amnesty bill through until the American people cried in protest. These same Republicans while not declaring war, allowed two wars to be started which is bad enough, but failed to budget them which was their responsibility to do. The list is longer if you want me to continue.
Our current congress has made no attempt to defund anything nor have they made any attempt to reduce spending at all. Boehner has had more headlines golfing with the liberals than he has with any legislative accomplishments. Now I realize the apologists are going to cue up the usual excuses, but please, can we keep contintuing to be this stupid. Look at the current candidates. The only person calling for cuts to spending (which doesn't even touch the entitlement problem) and an end to our empirical machinations is considered to be bat shit crazy. The only non-career politician wants to implement a new national sales tax. Two democrats turned Republican are considered to be front runners, yet neither one have any plan to reduce the size of government nor change our unsustainable foreign stance and what's worse pretty much have a track record of liberal accomplishments.
Sorry for the rant, this all is making me crazy.

Most people can't even tell you how many Articles are in the Constitution, let alone what is in them. Simple answer: Seven, one for every day of the week. When an ignorant and ill-informed populous rely on political operatives to tell them what their rights are, they become privileges, and if you don't KNOW what your God-given inalienable Rights are, how will you know when someone (or the government) is abusing them?
I would encourage every to get their hands on a pocket Constitution. Carry it with you. Read it. Re-read it. Read the Federalist Papers. Read your state constitutions as well. Put down the T.V. guide and the T.V. brick, and get involved with your federal, state, and local elected officials. Educate and/or replace them as needed.

The liberal judges on the Supreme Court were appointed by President's elected in democratic elections as were the Senators who gave "advise and consent" to their appointments

I am a white South African, my genealogy going back to the 1600’s in this country.
I do not belong to a political nor religious organization, and speak as an individual citizen.
My views are my own, formed from personal experience by living in South Africa since I was born in 1959.
Hereby I ask you to intervene in the situation presently existent in South Africa, whereby the blatant extermination of people living in South Africa, which are not affiliated with the ruling political party, namely the ANC, and are not of black skin colour, is taking place at an alarming rate.
The ANC has formed a Tripartite Alliance with the SACP (South African Comunist Party) and the PAC (Pan Africanist Congress) to form the National Democratic Revolution.
Of significance is the ANC YL Political Educational handbook, on which the emblem
of the National Democratic Revolution is prominent, and to which I will refer as part
of the basis of this letter, and of which a copy is included as Attachment 1.
Of interest is that they make it very clear that their aim is to create a socialist country to create the bridge between nationalism and communism.
Also, that they do not envision any differences in the nation, and only their own type would be tolerated as a single, collective South Africanness—‘dispelling of narrow ethnic, tribal and racial nations’.
Therefore, such extermination of ‘tribes’ is viewed necessary for them to achieve their mission, and the ideal of a ‘rainbow nation’ as pictured by the ANC is an illusion, as can be seen by the total disregard to the lives of the citizens of South Africa, as well as their property, by the existing powers of government have proven.
In their strategies they mention ‘The third dimension’ is revolutionary nationalism. Their definition of a revolution is:
• A change in social, political and economic relations;
• A change of the ruling class through elections or violent insurrection, and of great importance, that their own followers dont realise, is that
• individual ownership of property will be abolished. Ownership of personal effects such as clothes, a tv or ipod will be allowed, but certainly not a piece of land, house, building nor business.
The National Democratic Revolution is a member of an International Movement by the PAC in which they claim to work together to end corruption and set a new agenda to restore the stolen pride and peace of Nigeria and Africa. This movement is also supported by Gaddafi, who has placed $97 billion on the table to “free Africa from Imperialism”. They are calling on all Africans worldwide to take part in their “struggle for freedom” and more information on their mission can be viewed on their website called ‘Everybody HasTo Be Involved In Project Africa.’
The month of October is chosen in which to show alliance to this movement, commonly dubbed “Red October”. The ANC Youth League have planned non-peaceful mass action on the date of the anniversary of the establishment of their party, namely the 27th of October. The purpose for this action is to demand ownership of the mining and financial institutions of South Africa. Thereafter they intend to demand ownership of all property in South Africa without paying the owners thereof any monies for it. The attitude is that all land in Africa belong to the black man, and that the Europeans had stolen the land from the Africans. Europeans are thus dubbed as thieves, and it is not considered incorrect to steal from them.
My personal study of such action is stored on the website http://sasmarts.weebly.com for reference. However, the information contained here is not, by far, complete on the whole situation.
What does stand out in studies of the political situation is the recurrence of the word “Uhuru”, also known as “the night of the long knives”. Although dubbed by some as urban legend, it appears to be very much alive in the minds of many, as can be seen in a letter addressed “To The White Man” by a Black South African, and which is enclosed as Attachment 2.
The event of Uhuru is said to take place 7 days after the death of Mr Mandela, accepted as the father of the ANC. What is disturbing, are the rumours of his death, and also the fact that Mr Mandela was transported a few weeks ago to his place of birth for burial, should he pass away. No one has seen any signs of him being alive since this transportation has taken place.
Further signs of Uhuru being very much alive was recently seen by motorists as they passed the De Brug military base near Bloemfontein, where 600 ‘Narysec’ recruits received military training. Its commander instructed his soldiers to paint the word “Uhuru’ on boulders overlooking the highway to Bloemfontein. An article covering this is enclosed as Attachment 3.
Of interest also are the 8000 soldiers which the leader of the ANCYL employed recently. It appears that the example of Somalia was followed, and brings to mind the following fact:
SOMALIA: The African Union peace keeping mission, whose 8,000 soldiers are crucial to the battle against Islamic radicals in Somalia's capital Mogadishu, could be severely weakened if the AU lost the financial support of Gaddafi. In 2008 Libya decided to grant an investment fund to Somalia through the Sahel-Saharan Investment and Trade Bank to fund infrastructures such as roads and bridges within Somalia.
To supplement the numbers of ‘freedom fighters’ in South Africa, its borders have been opened to militants trained in terror operations from other African states. These militants arrive in South Africa, hungry and homeless. They have nothing to loose, and the only way they know to survive, is by pilfering. Most of them were taken as children, and were brain-washed in the art of torture and murder. Many attacks on South Africans are masterminded by these illegal immigrants. Furthermore, they infiltrate squatter camps designed for poor South Africans, spreading fear and discontent through their aggression and thieving.
Their numbers have grown and are estimated to be in the region of 29 million.

Johannesburg - "You South Africans will now know how it feels to be injured. "We're going to kill you."
This is what a group of, presumably Congolese men, allegedly shouted at six security guards that were held hostage at the Glenanda camp for victims of xenophobia in Johannesburg. Theuns de Lange, 38, of the Interactive Protection security company that was looking after all the safety camps in Johannesburg, on Thursday talked about how he and five other guards were held up and threatened with death. "They meant what they said. "They said they were going to kill us all if the police came. It wasn't nice because you didn't know what to expect," De Lange said. The gang apparently tried to take the pistol of one of his colleagues. De Lange and this colleague were detained at about 06:10 on Thursday morning by seven Congolese men in the camps. The men, who are apparently part of a gang, took four of De Lange's security guards hostage on Wednesday evening. The men were armed with knives. The police later released the hostages and no-one was injured.
There are still about 2 000 foreigners in the camp, most of whom are Congolese.
The managing director of Interactive Protection, Nantes Rykaart, said the Congolese gang was a big problem in the camp. He described the Glenanda camp as the most problematic. "The gang members prevent the elderly from queuing for food and want them to pay for food later on. They don't want the security guards at the camp so that they can take over," Rykaart said. Police spokesperson Lungelo Dlamini said ten people were arrested after they apparently threw rocks at police as they tried to free the security guards. The police fired rubber bullets at the people. Dlamini said the possibility that they would also be charged with kidnapping was still being investigated. A Malawian, who was hit by rubber bullets three times, said the police opened fire on the people without reason. "I went to help the guards when the police started shooting at us," the man said. He was wounded in his right arm, left side and left buttock. The police were still at the camp late on Thursday afternoon to make sure the situation remained under control.
The movement by the National Democratic Revolution in implementing their plans towards attaining complete control of the assets and the South African nation as a whole, concentrates on the support of the unemployed masses. Most of this unemployment was brought about by the workers union, CUSATO, which also forms part of the National Democratic Revolution.
Unrealistic stipulations forced upon employers has resulted in the closing of many businesses and mines since 1994. Implimenting BEE (Black Economic Empowerment) as a pre-requisite to any new and existing business means that at least 51% of the business must be owned by a black partner.
Uncontrolled murder of farmers has made farming the most dangerous job in the world. The loss of white farmers in the South African economy has left thousands of
farm labourers unemployed and homeless.
Financial institutions, that offer monetary security for the citizens in South Africa, are now being targeted. Ownership of the stock exchange market is also being claimed by the National Democratic Revolution, led by the leader of the ANCYL, Mr Julius Malema. Mr Malema is calling upon all black youths to take part in the planned take-over scheduled for the 27th and 28th of October, 2011, and his invitation can be read under the title ‘The Madness of Malema’ in the Attachment 4
Indeed, such a take-over would be complete economic suicide for South Africa.
Corruption and mismanagement of funds by government officials have rendered all municipalities of the country bankrupt. Import duties and taxation on all commodities create a vast gap between the working class, and the government departments which collect these monies. These monies are not utilized to maintain, nor expand, the infrastructure of the country.
The once proud, economically strong and thriving South Africa, known as ‘The Basket of Africa’, is being mismanaged to the extent that all its citizens are in danger of starvation, or being murdered.
It is clear that the situation in South Africa is out of control, and despite sanctions on information relating to the information provided to and by the media, the population are becoming aware of the dangers to which each person in South Africa is very real, and life threatening. A feeling of unease, fear and anger is re-asserting bonds in tribes and a rift based on colour is developing between many groups, banding together for safety.
From my own personal experience of living in South Africa, I have taken the liberty of
enclosing a letter as Attachment 5.

This country was not founded as a democracy. Our founders knew the wisdom of the past that democracies do not last long after the proles learn that they can vote for themselves what they are unwilling to work for. Progressives are not particular about the form of government so long as they, the self selected elite control the levers of power. If their cause is popular they call for the will of the people to be done. If not, they deride the great unwashed as not being capable of judgment and their betters must decide for them.

But... The Constitution is real and the Bible is real. There is no denying that all that was prophesied to happen has, and there is a little more to come. Many of you are stating just what is prophesied to happen in this time frame in the Bible, without even knowing it. It doesn't look good and it's going to be very bad for not only America but for every other Country in the World.
You are seeing things happen that have been foretold to happen right before your eyes. Some of you know this, some are just realizing it and some say they'd rather just read news articles like this and complain about them. Some say it's time to fight. But..... sadly enough to say, you will simply be kicking against a big rock.
I'm not saying to just give up. But I am saying it's wise to know exactly where we are in history and time, and it's wise to know what can be changed and what can't.
Reading news articles only lets you know what happened yesterday, today and what "could" happen tomorrow and gives you an avenue to vent your frustration. Reading and understanding the Bible lets you know what happened over 2,000 years ago and what is happening now and what will happen a few years from now.
Now the wise man will put this "all" together and learn from worldwide current events AND from Biblical Prophesy and Eschatology and from this, he will know what can be done and what can't. He'll know how t0 fight and what to fight for.

In considering the claims about the work of Herbert Croly, I am intrigued by first, the idea that the notions of our Founding Fathers about democracy as expressed in our founding documents, must yield to the pressures of developing notions of good sense, and secondly by the concept of "national democracy." What is the meaning of such a term? Can there even be such a thing as "national democracy?" Doesn't the term contain an inherent contradiction or paradox?
I'm probably wrong. After all, Croly is a smarty; he wrote a whole book.

It depends on what elections you're discussing. It WOULD make sense, for example, that only property owners should vote on matters that raise or lower property taxes wouldn't it? As far as WHO gets elected, then it would make sense to include everyone. How to do that would be a bit complicated, but it wouldn't be impossible, especially given that we have computers to figure these things out now. At the Founders time, it would have been an almost impossible task. They were limited by the technology (or lack thereof) they had available.
It seems a bit unjust for people who do not pay property taxes to be able to shift burdens to property owners, or to raise these taxes, knowing full well that it will not be a tax they will have to pay. It becomes even more unfair when these same voters then pass laws that make it impossible for property owners to raise rent more than X percent per year, sometimes not even allowing for increases in property taxes. And then these jackasses wonder why a landlord will allow a rental property to become a slum. Maybe because his rents are less than his costs?

The reason the founders only gave the right to vote to property owners was that they were the only ones paying taxes. What is meant is that only taxpayers should have the right to vote. No representation without taxation.

The most dangerous institution we have is the court system. Our judiciary has gone from ruling on facts based on the law, to sitting as Solomons, and ruling according to their feelings. They decide what they want the outcome to be, then bend the law to make it fit.

Agreed with all points except the definition of the word "liberal." These people are socialists, not liberals. Liberalism believes men of good will can and do disagree as to the nature of problems and their solutions therefore it behooves us to put our heads together and come up with a solution better than either can come up with on his own. A socialist, by contrast (which many who call themselves liberals are) believes in shaping the society and penalizing all who do not participate in a consensus. It does not allow the free flow of ideas or anything else. It tends to two styles of totalitarianism: national and international, otherwise known as fascism and communism.
The problem with allowing socialists the free use of the word "liberal" is that it perverts it within the nation and puts us in a contradictory position when defending liberal democracies abroad against, for example, Islamofascists, kleptocratic autocracies and juridical oligarchies such as Iran's. Some distinctions of governmental form are necessary and in allowing socialists the use of the word "liberal" we put ourselves on a bad footing. We should challenge their so-called liberalism at every turn. What is liberal about stealing the taxpayer's dollar and giving it to some dictator in the Third World in the name of humanitarianism? I think anyone who actually read the draft bills from the last major attempt in the 108th Congress would have a good laugh.
A close review of HR 163 (Rangel D-NY) and S 89 (Hollings D-SC) reveals the "twin" documents are not twins at all. But don't take my word for it, go to thomas.loc.gov and lookup HR.163 and S.89 from the 108th session and compare.
S.89 talks about "active duty and reserve" components while HR 163 talks about "active duty and reverse" components, in 5 different places. Yes, it says reverse (i.e. backward). The version of HR.163 that came to the floor of the House and was actually voted on, talks of "active duty and reverse" components. I don't know about you, but I assume that a reverse component would be in charge of retreats and surrenders (has a definite John Kerry flair to it).

All of the above and so much more is the reason we have 40+ million Americans without healthcare coverage. If the republicans wanted to do something about this shameful problem, they could have anytime over the course of the last 50 years! ObamaCare, which is essentially private health insurance, is a good idea for all Americans, not just those with private health insurance.

I'm not sure exactly what you are saying or are you just being "cute"? I have spent 35 years of my professional life in healthcare and I have quite a bit of knowledge and direct experience in this matter. If you don't think rationing [limiting access to a resource] is occurring in the healthcare field, you are as blind as blind can be. Afterall, private medical insurance is a 3rd party reimburser and often a for-profit company; it enhances their bottom-line to limit access to care as that enhances the almight profit!

As always, Mr. Tyrrell is very insightful. The problem goes much deeper than just the incompetent ideologue who is our current POTUS, and the solution must go much deeper than just replacing him. We have to restore the original constitutional limits on the federal government which leftists have been dismantling since the days of Herbert Croly. Given how entrenched are the Supreme Court precedents since the New Deal which have authorized this unconstitutional expansion of the federal government, and the vested interests which protect it today, only constitutional amendments restating the original constitutional framework can restore the original limits on our national government. There is wisdom in this article. But the presumption of moral superiority is a vice that anybody ( especially any politically active person ) is vulnerable to. A long term project for constitutional conservatives needs to be a cleanup and simplification of law especially federal law. Conservatives and even libertarians are capable of abuse of power if the path is easy enough.

It's not just "clap trap" legislation that's the problem. A key component of the problem are those political animals who see "face-time" and personal political capital as more important than sharing the 'truths' that they know. For example, you mention Betsy McCaughey. The former Lt. Gov. of New York has a PhD in constitutional history. If anyone should know what it means, it's Betsy. I spoke with her at a conference back in March at which she was both a speaker and panelist. My concerns, then and now, as it related to Obama Care, were more focused on the root problem the court challenges posed, not simply the legislation itself. I spoke to Mrs. McCaughey about the constitutionality of the lawsuits against Obama Care, as well as the cases against Arizona's SB-1070. In private, she agreed with our analysis and research that under the "original jurisdiction" mandate of Article III, Section 2, Clause 2, that NONE of the judges who had heard the cases at the federal district and appellate levels had any Constitutional authority to hear the cases brought before them, yet publicly, at the conference, she praised the district judge who struck down as un-constitutional, parts of Obama Care. I was disappointed. Other supposed champions of the Constitution have also made the "strategic" decision to violate their oaths of office, squandered tens of thousands if not millions of taxpayer dollars in the process, and further weakened States' Rights and the Constitution in the process. The Supreme Court, from day one, should have heard these cases. Governor Brewer, for example, should have told U.S. A.G. Holder to go away, that if he had a problem with Arizona law, to file his complaint in a court that has Constitutional authority to hear it. She did not. The same is true of VA. A.G. Statute and precedent do not trump the Constitution. Until governors and states' attorneys general start keeping their oaths, the feds will continue eroding State sovereignty, States' Rights, and the Rights of the People.

I agree Mr. Dubose. The legislative process and the sheer volume of the convoluted legislation introduced in Congress must be repaired. James Madison said it best:
