What Biden Considers Un-American

Joe Biden has called the Texas law prohibiting abortion after six weeks “almost un-American.” Never mind that abortion itself is a blatant violation of America’s founding commitment to protect God-given rights, starting with the most fundamental one, the right to life. If anything is un-American, it is Biden’s moral and political agenda, which seeks to create a dysfunctional new political order alien to the country’s Judeo-Christian foundations.

The Democrats have joined Biden in casting the law in Texas as an assault on American democracy. How absurd. The law is not contrary to American democracy, but a reflection of it. A majority in Texas supported the law, and the Supreme Court, for once, didn’t interfere in that simple exercise of democracy.

It is the Democrats who favor wresting away from the people the right to determine their own laws. The undemocratic impulses of the Democrats have been on open display since the Texas law passed. Democrats immediately responded to it by calling for packing the courts with judicial activists. The Democrats want a handful of judges, not the people, to dictate abortion law.

Biden’s philosophy of the judiciary is inherently undemocratic. It amounts to a tyranny of judges over the people — judges who invent “rights” out of thin air and then prevent the people from passing laws that diverge from the ideological preferences of those judges. That is fundamentally un-American. The judicial despotism to which Biden subscribes would create an America of, by, and for liberal elites.

“Decisions like this one chip away at our democracy,” Congressman Jerry Nadler said about the Supreme Court’s unwillingness to block the abortion ban in Texas. No, that restraint from the court was a rare nod in favor of democracy. The court normally can’t resist meddling in abortion politics at the state level.

The court’s decision would have pleased the late Supreme Court Justice Antonin Scalia. He once warned his colleagues: “by foreclosing all democratic outlet for the deep passions this issue arouses, by banishing the issue from the political forum that gives all participants, even the losers, the satisfaction of a fair hearing and an honest fight, by continuing the imposition of a rigid national rule instead of allowing for regional differences, the Court merely prolongs and intensifies the anguish. We should get out of this area, where we have no right to be, and where we do neither ourselves nor the country any good by remaining.”

Biden’s agenda is not to expand the democratic choices of the people, but to restrict them and use executive power to impede democratic results in the states. No sooner had the Texas law passed than the same Democrats who whined about Trump’s supposed politicization of the Justice Department called for it to thwart the will of Texans. Attorney General Merrick Garland has jumped to the attention of his political masters and deployed Justice Department resources against the Texas law.

This is, of course, the same Merrick Garland who the press tried to pass off as a moderate after Obama nominated him to the Supreme Court. These days Garland sounds like a lawyer for Planned Parenthood.

“We will not tolerate violence against those seeking to obtain or provide reproductive health services,” he said about the Texas law. But he will tolerate violence against unborn children.

One would think the Democrats might want to avoid the word “violence” in any discussion of abortion. But they don’t. They continue to act as if they occupy the moral high ground. Even as they support a culture of death, they liken Republicans to the “Taliban.” But it is the hands of the Democrats that are bloody.

The Taliban and Planned Parenthood are both in the business of killing the vulnerable. The Democrats have gone from claiming to be the “party of the little guy” to warring on him in the womb. Nothing is more important to them — as evident in their hysterical, all-hands-on-deck response to the Texas ban — than that act of violence.

Biden’s definition of what is and what is not un-American is perverse. He sees nothing un-American in boycotts of the flag, and he will even invite athletes to the White House to stage them. Opposition to abortion, on the other hand, merits his deepest scorn. He can take a knee with Black Lives Matter and fly its flags above American embassies, all while casting peaceful pro-lifers as a threat to America’s future. Yet it is the country that Biden seeks to build — one in which universal abortion on demand is protected in perpetuity by judicial tyrants — that the founding fathers would have called unrecognizably American.
