Speaking of Mitch Daniels, Jake Tapper reports that Centers for Medicaid and Medicare Services administrator Donald Berwick has rejected Indiana’s ban on Medicaid funds for Planned Parenthood and other abortion providers. According to Berwick, the ban would violate a section of the Social Security Act that mandates that “beneficiaries may obtain covered services from any qualified provider that undertakes to provide such services.”
Unless the state takes legal recourse, it will have to comply with Berwick’s letter (available here) or face penalties.
