Are Marilyn & Nick Mosby The New Clintons?

I read Ben Stein’s weekend column on last week’s Baltimore riots. He was not kind to prosecutor Marilyn Mosby writing that she “should not be allowed to be a law clerk, let alone a state’s attorney/prosecutor.”

What Ben doesn’t mention is that Mosby’s husband Nick is a Baltimore city councillor who was interviewed by FNC’s Leland Vittert at last week’s riots. While Mosby condemned the violence, he did not hesitate to rationalize it:

This is about the social economics of poor urban America. These young guys are frustrated, they’re upset and unfortunately they’re displaying it in a very destructive manner. When folks are undereducated, unfortunately they don’t have the same intellectual voice to express it the way other people do, and that’s what we see through the violence today.

When Vittert steered the conversation back to the rioters, Mosby went on the defensive:

The violence is wrong. That’s never acceptable… There’s a symptom of something that’s going on here, and what I’m trying to articulate to you is that when you look at communities like this in urban America, it’s lack of education. Lack of commercial development. Lack of opportunities. It’s the socioeconomics of it. It has nothing to do with West Baltimore or this particular corner in Baltimore. This could erupt anywhere in socially-economically deprived America.

Eventually, Mosby grew impatient with Vittert and abruptly ended the interview.

I can understand why. His arguments don’t hold water. Only New York City spends more per pupil than Baltimore. It’s not how much you spend, but how you spend it. Then again if a critical mass of the African-American children regard education as “acting white” then it doesn’t matter what you spend on education if they don’t place any value on it.

If the kids in Baltimore were upset at the lack of commercial development then why are they going after CVS?

Mosby does the greatest disservice when he says, “When folks are undereducated, unfortunately they don’t have the same intellectual voice to express it the way other people do, and that’s what we see through the violence today.” In so doing, he’s infantilizing his own community. Undereducated or not, these kids know right from wrong and choose to do wrong because there aren’t enough Toya Grahams to tell them no. 

It is important to keep this mind concerning the prosecution of the six Baltimore police officers. Now, believe me, if the evidence warrants that they be locked up then so be it. The police do not have unlimited authority. At the very minimum, there was some kind of negligent behavior on the part of the officers involved in detaining Freddie Gray. Dr. Ben Carson believes “direct trauma” was inflicted.

Yet Marilyn & Nick Mosby have been profiled as Baltimore’s new power couple. Who knows? Maybe they will be the new Clintons. Given this status, it is not unreasonable to conclude that Marilyn Mosby is in simpatico with Nick Mosby when it comes to rationalizing violent behavior. Is it possible that these beliefs rather than the evidence is driving these charges? Alan Dershowitz certainly thinks so.

What worries me is that we could have another Duke Lacrosse Team snafu on our hands. Mike Nifong’s political zealotry and willingness to withhold exculpatory evidence would result in his disbarment. What will Mosby do should evidence come to light which exonerates one or more of the accused police officers? Based on her statements, I wish I could say without reservation that she would disclose such evidence to the defense forthwith. But I cannot. I believe I have a reasonable doubt.
