New York certainly isn’t giving up its status as the abortion capital of the nation anytime soon. Today, Governor Andrew Cuomo released a bill that would expand legal abortions after 24 weeks.

In New York, women can only receive late-term abortions if their lives are at risk; however, federal law permits late-term abortions if the pregnancy more broadly affects their health. Cuomo’s bill would put his state’s laws in alignment with federal law.

“It’s fear-mongering. There is a simplicity and a clarity to the ‘choice’ language. You’re pro-choice or you are not pro-choice,” said Cuomo, according to CBS New York.

Apparently there’s no middle ground on late-term abortions either.

The abortion clause is written in the last item of Cuomo’s ten-point Women’s Equality Act. The bill is most likely to pass in the State Assembly, but Democrats do not have a functional majority in the Senate; therefore, its outcome is unclear.

“We do not have any assurances,” Cuomo said at a news conference. “But the language of this bill, I believe, this is a bill that can and should pass.”

Cuomo is moving in the opposite direction of the Pain-Capable Unborn Child Protection Act, which Jordan discussed earlier this morning. That bill, if passed, would ban abortions after 20 weeks nationwide.

In the early 1970s, New York was one of the most liberal states in terms of abortion policies when it legalized abortion prior to the Roe v. Wade ruling. Under Cuomo’s bill, it would remain so even if the federal law was overturned. Apparently New York City’s 40% abortion rate, twice the national average, is not enough. Now, if the Court was to toss out Roe v. Wade and leave the decision of abortion up to the states, New York could remain a hotbed of abortion under many circumstances.
