I hate to disagree with my friend Ross Kaminsky again, but I think IPAB absolutely must be repealed. Why? Because it is unconstitutional — and no matter what other considerations apply, that which is unconstitutional should not be allowed to stand. And we shouldn’t wait for the courts to declare it unconstitutional ; it is the province of Congress, too, to correct a constitutional error of its own making.
