The Sequester Amnesty

The lawless Obama administration is brazenly endangering the country to prove a political point.

Because the word “sequester” sounds more like a bronchial infection than a governmental disaster, President Obama failed to terrorize House Republicans into raising taxes in order to avoid it.

They tried everything they could think of to scare us. We’d have meat shortages because federal inspectors would be laid off, long lines at airport security stations would get longer because the TSA molesters would be cut back. Education Secretary Arne Duncan earned four “Pinocchios” from the Washington Post’s Fact Checker column for brazenly lying about teachers he said were already being laid off in West Virginia.

Duncan, for all his faults, is relatively harmless. The same cannot be said about Homeland Security Secretary Janet Napolitano, whose department has begun releasing criminal illegal aliens — which for this discussion is not redundant — from the jails where they were being held pending deportation. Even before Friday, when the $85 billion in cuts took effect, Napolitano’s Immigration and Customs Enforcement began releasing criminal illegal aliens among the public.

It’s the Obama administration’s “sequester amnesty,” which endangers the public to make a political point.

Pinal County, Arizona, is about seventy miles from the Mexican border. It’s larger than Connecticut, running south and east from the city of Mesa. Its sheriff, Paul Babeu, is a tough guy in a very tough place. And both his job and his county are made a lot tougher by ICE’s release of an unknown number of these criminal illegals, people who were held pending deportation because their criminal records made them “inadmissible” into the United States.

Arizona is high on Obama’s list of enemies. It’s the state Obama’s Justice Department sued to set aside the state law that enables the arrest and detention of illegal aliens. The Supreme Court struck down part of the law, but left in place the part that allows state law enforcement officers to check the immigration status of people they’ve stopped for other reasons.

Obama’s position is that federal law preempts any state law to control illegal immigration and any state action for which the state lacks federal permission is impermissible.

Sheriff Paul Babeu of Pinal County, Arizona, is trying to deal with that one-way street. I interviewed him on the Roger Hedgecock radio show last Thursday. What Sheriff Babeu told me is shocking. It confirms that our government is now willing to endanger public safety to prove a political point.

In December 2012, Homeland Security’s Immigration and Customs Enforcement agency had more than 33,000 illegal aliens in custody pending deportation. These aren’t people who were arrested just because they were illegal aliens. They are criminals, held by ICE because they were convicted of separate crimes, usually serious felonies, and held after they’d served their sentences until they could be deported. Others have long criminal records in their own countries who came here to do more of what they did at home.

Federal law allows these people to be held for up to six months pending deportation. Some, from nations such as Pakistan, are held for that long — and should be held longer - because their country of origin won’t issue travel documents enabling their return. The non-cooperating nations are content to leave their problems with us, be they terrorists or drug traffickers.

The federal government says there are 11 to 12 million illegals in the United States. Sheriff Babeu told me that 300-500 of the 34,000 criminal illegals held in pre-deportation detention were released into his county two weekends ago.

Janet Napolitano said that ICE won’t be able to maintain 34,000 criminal illegals in custody — not because of legal limitations on incarceration, but because of the sequester. In a statement to the press last week, she said, “Look, we’re doing our very best to minimize the impacts of sequester. But there’s only so much I can do,” Napolitano said. “I’m supposed to have 34,000 detention beds for immigration. How do I pay for those? We want to maintain 22,000-some odd Border Patrol agents. I got to be able to pay their salaries.”

Babeu told me that neither he nor the county’s police chiefs were given notice of the release. “The doors swung open and there they go,” he said.

I asked Babeu if he even knew who these people were. He said that he’s asked for that information numerous times, including by letter, and ICE has refused to tell him. “These people were released into the community. We don’t know their names, we don’t know what charges they were held on or their criminal history.” He added, “But we do know this: this is the same group that Janet Napolitano and Barack Obama have all agreed that these are the worst of the illegals.”

ICE is saying that some of these illegals were released on terms that supposedly provide some supervision. Sheriff Babeu is, to say the least, skeptical.

The miserable economy is on purpose to turn millions of independent Americans into government dependents - and its worked. Right you are, Al. It's beyond disconcerting; it's beyond worrisome--it's ominous. These "street-sweepers" and a billion-plus rounds of ammo for Homeland Security, drones over the civilian population, while releasing dangerous illegals? For exactly what purpose? A large-scale domestic military is being assembled, when we have a military to protect against a mass invasion.

I'm tired of this not being front-page news, at least for Fox and sites like TAS. My congressman is a good conservative, and I'm writing him about this issue. If anybody else has a likely-responsive congressman (or Senator), I suggest they contact him or her also.

I think that an interesting side note is which Janet is more frightening, Napolitano or Reno.

While each certainly causes shivers when one considers the physical attractiveness scales, does Janet Reno's hands on approach in killing Americans seem better than Napolitano's insistence that previously incarcerated illegal aliens commit the crimes that Americans just won't do? Do Janet Reno's efforts to disarm Americans pale in comparison to Napolitano and the Obama administration efforts to do the same, after assisting in arming the criminal cartels first?

I think if you develop this, TLP, you might have a theme for a future contest.

Lawless is a good term to describe this administration. Everything is done for political advantage regardless of the harm to the country. The regulatory agencies are routinely used to punish States which do not comply with directives from the central authority.

Immigration (illegal migrants) is not the only issue facing AZ. Other States have suffered the wrath of EPA, such as Keystone, and have had coal fired power plants closed or made too costly by regulation. New Mexico is facing similar acts, but Pete can fill in here. What is the situation out in AZ? Are TLPs questions about Napolitano on point. I thought she was a carpetbagger from the Clinton administrations DOJ.

Look around the country and see which states, especially those opposing obamacare and gun control, are being harmfully regulated.

To make an effective argument that may work with liberals, republicans should drop the nagging for a reduction in government spending and use sequester as a control lever for tax cuts and deregulation. Economists on both sides of the isle can agree that with the loss of America's business cycle, economic variables—once predictable—are no longer easy to control. The problem with tax cuts for many liberal economists is, in theory, they have never been a part of Keynesianism. For them, Arthur Laffer is responsible for postulating (with his curve) a phony theorem that tax cuts could increase revenue. Unfortunately for Art, while his tax cut theory was dubious at best when analyzed in the economic environment of traditional business cycles. The sale to liberals and America—for republicans—is that in a world economy the tax rate on businesses become more relevant (and so does Dr. Laffer) to maintaining competition. Stifling regulations also impede entrepreneurs in their quest for an adequate return to their investment worldwide. Therefore, give liberals a short-term spending package to reduce unemployment, increase payroll tax revenue into the U.S. Treasury and pay-down long-term national debt. Again, republicans should argue tax cuts and deregulation are a relevant part of economic growth in America’s current position in a world economy.

Education time.

Congress does not write immigration LAWS, it writes immigration and naturalization RULES. (Read the constitution).

The difference is that LAWS apply to citizens while RULES apply to those who are not yet citizens, since they are not under the jurisdiction of the United States. To become citizens, they have to follow the RULES of naturalization -- not break the LAW by illegal trespass.

What Arizona did was enforce federal LAWS pertaining to TRESPASSING (you are not allowed to come here illegally -- did you that?). The same way a foot patrolman in Phoenix has statutory power to interdict a federal crime in progress (i.e., a bank robbery or a kidnap victim being carried across state lines).

It seems tome that we can look for no sane help from our heroes in Washington. It will be up to the states to take control of their own situations, and protect their own citizens. In that the political party in power in Washington refuses to obey the law, or honor Court process, perhaps the States should take a page from the same play book. Enforce local and state laws. If Washington can get one of its idiotic federal judges to issue orders mandating foolish orders detrimental to the citizens of a given state, simply ignore them. Seems to be a trend anyway.
It will be interesting to see if any state's National Guard will enforce an order from Washington clearly detrimental to the fellow citizens of that Guard unit. As an attorney in the general practice for more than 40 years, I can attest to the fact that our judicial system has done more harm to the culture and fabric of this country than any other institution, up until now. Now it seems that the legislative and executive branches are vying for the title. How sad. Time to protect ourselves. After all, this is a country of, for, and by its people.

What will the courts do? Half the judges are anti-constitutional liberals in love with their own power. Even if a judge rules against Obama, he will just ignore it.

The evil of Obama is revealed in the fact that he actively hinders people from helping themselves. It is bad enough he will not enforce our nation's laws, but he actively blocks local initiative. He has greatly expanded the welfare state and continually harasses the private sector. If you want a template for what Washington will be like in a few years, look to Detroit. But even there, the Republican saviors of the downtrodden can't keep their noses out. Michigna's governor, Snyder, has insisted in saving Detroit form itself, and is insistent on dreagging its citizens, crying and screaming, into fiscal safety. All it will take is other peoples' money. Rather than allow the fools to sink into bankruptcy, he insists in appointing someone who will fail while falling on the borrowed sword.

Washington will be in this position by the end of Obama's 4 years. Unless the states decide to just take care of their own house, it is my bet that some Republican fool will appear and suggest that all of the rest of us (the states) pitch in and save what is still spinning around in the nation's capital. After all, we would not want all of those poor federal workers to take a pay cut, or lose their pensions and health benefits. Then we will be ready for another round of progressive invention.

I'll have to agree with the story, Obama has declared war (a cold one soon to be a hot one) on Arizona. Of course the 2,700 mini tanks recently acquired by the DHS would have went a long way in paying for the incarceration of the 37,000 illegals just released, but I digress. Afterall, those 2,700 bomb proof street sweepers will be used on those who are the greatest threat to the USA. Middle class, veterans, right wing bible thumping Christians. Everything is going to be alright. That purchase can complement the billions of rounds of bullets, enough for five rounds per US citizens, and I guess the 37,000 illegals will get off with a slap on the hand, and a voter registration certificate, all free of charge. The half breed president, and his manly woman in charge of the DHS, why should they give a crap about the condition of the country? They're safe and sound, for life, while the rest of us goes to he-- in a hand basket.

Did anyone notice that they had started releasing these people BEFORE the sequester took effect? So they never expected there to be any sort of compromise before the deadline and were going to make sure there wasn't one as evidenced by OBAMA!'s refusal to negotiate anything. This was planned and premeditated and if anyone is killed by any of of these illegals that is released then the administration should be held criminally accountable. Will it happen? Yeah right!

At a Friday press conference, Barack Obama stated that the people who take out the trash at the White House were getting a pay cut as a result of the sequester.

On Saturday, fact-checkers were out in force stating that in fact, no one who works at the White House was getting their pay cut at all as a result of the sequester.

Also, the trash is still in the White House.

This, of course, was predictable.

So is the lamestream press' assessment of this news item as "right-wing craziness" (just as the Hitler-friendly press in Germany characterized every report of atrocities against that regime's victims as "untermensch craziness").

Which brings us to the facts on the ground - before Barack Obama leaves 1600 Pennsylvania Avenue, it's but a short wave of the condescending hand from this release of violent felons (it doesn't really matter why, just that these felons were released without any court's involvement or any concern for the safety of the people of Pinal County) to the commission of atrocities at the specific behest of the Law-Breaker in Chief, Barack Obama.

Why not? Obama BEGAN his administration by telling SEIU goons to "get into their faces" at "town hall meetings on health care," and YouTube is full of video of the elderly and defenseless being roughed up by just those goons for daring to call Barack Obama's enablers on their lies about health care. Obama LED with a pilot plant version of the Kristallnacht.

So it's not implausible at all that atrocities will be committed in the near future by former detainees released in small communities with no real ability to beat back an instant crime wave thousands strong BUT their privately-held guns. After all, we're talking about professional criminals here being given no means of support but their calling - theft, assault and other crimes against the innocent.
