The Supreme Court has ruled the Defense of Marriage Act unconstitutional 5-4, with Justice Anthony Kennedy swinging the vote.
According to SCOTUS Blog, DOMA “is unconstitutional as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment.”
Chief Justice John Roberts, associate justices Antonin Scalia, and Samuel Alito all issued dissenting opinions. Justice Clarence Thomas joined Justice Scalia and Alito in part.
