The Fourth Circuit Court of Appeals has dismissed two constitutional challenges to President Obama’s Affordable Care Act. The three-judge panel ruled that Virginia had no standing to challenge the individual mandate and that Liberty University couldn’t sue until the law took effect. Two of the three judges were appointed by Obama, one by Bill Clinton. Virginia Attorney General Ken Cucinnelli has said he will appeal. This is the first court that has accepted the administration’s tax power argument for the mandate.
