I was pleased to see that former House Majority Leader Tom DeLay had his 2010 money laundering conviction overturned the other day by the Third Court of Appeals of Texas.

Although Ronnie Earle had retired as Travis County DA by the time DeLay had been convicted, DeLay’s decade long saga would not have been possible without Earle who had to convene six grand juries before one would agree to indict DeLay on…something, anything. The law which DeLay was accused of breaking was intended to be used against drug dealers, not for campaign finance matters.

In May 2005, four months before indicting DeLay, Earle gave a fundraising speech to a Texas Democratic Party gathering which raised over $100,000. During the speech, Earle described DeLay as “a bully.” After Earle left office, he unsuccessfully sought the Democratic Party’s nomination for Texas Lieutenant-Governor.

Earle’s “investigation” should have been stopped right then and there. Instead, DeLay has had to spend millions of dollars in legal fees and probably will have to spend a lot more. Current Travis County DA Rosemary Lehmberg has indicated her office will petition the Texas Court of Criminal Appeals regarding this decision.

For Tom DeLay, justice might once again be delayed. Or should I say DeLayed?
