As with his filibuster last year, I give Paul full credit for political theater and it keeps him in the public eye towards 2016. It’s also interesting that Paul has recruited former Virginia Attorney General and GOP gubernatorial candidate Ken Cuccinelli to take the lead in the case. (Perhaps Cuccinelli is a potential Attorney General in a Paul Administration).
But let’s call this for what it is — a cheap publicity stunt. While one can certainly make an argument against the NSA’s methods of intelligence gathering, Paul’s lawsuit against it is wholly without merit.
The argument against it is the same argument Senator Mike Lee of Utah posited concerning as to why no one has sued the Obama Administration for changing Obamacare through bypassing Congress. Unless Senator Paul or anyone else who sees fit to sign up for this lawsuit can demonstrate that the NSA caused them harm and the court is capable of remedying that harm, then Paul nor anyone else who sees fit to join it will have standing to sue. In which case, Paul’s lawsuit will be dismissed.
Given all the irresponsible lawsuits that are filed in this country, Rand Paul does a disservice by casting himself as an ambulance chasing, personal injury lawyer.
