Obama to Court: Drop Dead

No kidding.

Within hours of the Supreme Court’s decision on the Arizona immigration law — leaving in place a core section of the law that allows local law enforcement to continue checking the immigration status of anyone suspected of being an illegal — the Obama administration has just said it will no longer enforce the law.

Fox News reports that the U.S. Department of Homeland Security — that would be Secretary Janet “Big Sis” Napolitano — has just announced that the Obamites are “suspending a key program that allowed state and local law enforcement to enforce federal immigration law.”

In other words, they didn’t like the Court’s ruling so — they simply will not enforce the law because they don’t like it.

Why? The unspoken reason?

Progressives need to play the politics of race or they are out of business. So Secretary Janet Napolitano has just played the race card — effectively telling the Court to drop dead.

Who cares about the Constitution when the Latino vote is so critical?

Shades of George Wallace.

As we have discussed before, what recourse do the States retain when the Federal Government refuses to enforce its own laws? Clearly now with this court ruling, the States retain the power to enforce those laws. The administration is now in contempt of court with the directive to ignore (selectivly ie requests from AZ) to act on the feds own laws.

Article IV Sec 4 directs the national government to protect the States from invasion and to so act on request of the State legislature or Executive. Additionally the executive, the president, is obligated to take care that the laws be enforced. This president and this administration are now operating openly in violation of those Constitutional directives. Can the States sue to force the government to act or must they now look to their own defense to execute federal laws and protect themselves from invasion? If so has not the Federal government abrogated the compact through which the people ratified the Constitution?

If Obama refuses to carry out the duties of his office as specified in the Constitution, isn't that an impeachable offense? It's certainly more impeachable than having sex in the Oval Office. This is utter nonsense, Jeffrey. The Supreme Court only said that this one portion of the Arizona statute withstood challenge because it was not clear on its face that it conflicted with federal immigration policy, unlike the other portions the Court rightly struck down. The administration has simply made clear what that federal policy is, as is it's purview. The Supreme Court didn't purport to set any policy, so it's entirely unlike Wallace's resistance to a direct federal court order.

I'd like to see Janet's agents try to arrest Jan Brewer after she tells her Ariz. cops to go ahead and ask 'em for papers then lock 'em up when they don't have 'em.
A State-by State revolt of Governors against the Federal Govt. would be fabulous.
As in "John Marshall has made his ruling, now let him enforce it".

Then Janet would be doing EXACTLY what Wallace was doing - the Supreme Court flatly told Arizona it can't arrest people for being in the US without papers. Fortunately, I don't think any of the Governors have any intention of doing so.

The Court told the State it COULD investigate and detain suspected illegal migrants. It is the administration which sees this as a major defeat and it is now refusing to acknowledge the States role here or enforce its own federal law. The Scalia dissent does go further in recognizing that violation of federal laws may be treated as violations of State law by the States.

No. The court said that Arizona police who have some other legitimate reason to stop a person could, in the process, check their immigration status, but it could not detain them based on their status alone since the court struck down the provision allowing Arizona to arrest or otherwise enforce immigration violations:

"Detaining individuals solely to verify their immigration status would raise constitutional concerns. And it would disrupt the federal framework to put state officers in the position of holding aliens in custody for possible unlawful presence without federal direction and supervision. The program put in place by Congress does not allow state or local officers to adopt this enforcement mechanism."

The Constitutional crisis of Big Fed vs States and citizens is long overdue.
The judges and lawyers have waaaayy too much power.

Obama has essentially told the Arizona and the other states that if they stop for legal reasons and question the immigration status, the feds will not help.

See the news reports:

By Monday afternoon, the Department of Homeland Security had pulled back on a program known as 287(g), which allows the feds to deputize local officials to make immigration-based arrests. According to a Homeland Security official, the administration has determined those agreements are "not useful" now in states that have Arizona-style laws. Immigration and Customs Enforcement has since rescinded that agreement in Arizona -- with the state itself, and with three local law enforcement agencies.

The move means that even if local police step up immigration checks, they'll have to rely on federal officials to make the arrests.

And federal officials made clear that ICE would be selective in responding to the expected rise in calls from Arizona and other police agencies about immigration status. Officials said ICE will not respond to the scene unless the person in question meets certain criteria -- such as being wanted for a felony.

The bottom line is that there is no point in a state stopping and questioning.

What will Obama do to evade the Court's ruling to invalidate the health care law?

It was probably Napolitano's revenge against her political opponents in Arizona. When these clowns leave office in November, Republicans can attempt to restore sanity to our immigration enforcement, though I'm not sure establishment Republicans will do much better. A little better maybe, but probably not by much.

Obama has a powerful vehicle here. It now seems that he gets to arbitrarily decide policy on all issues over which the federal government is deemed to have "purview". He doesn't actually have to comply with congress or the Constitution on these areas; he can have whatever he wants be enforced. Rather than fighting him on it, the Court will fight anyone who tries to interfere...

It's time for Congress to man up and impeach the guy for failing in his oath to uphold and support the Constitution of the United States. I mean, after all, President Reagan fired the air traffic controllers. They just wanted more money. Obama is working to dismantle the very foundations of America. IMPEACH HIM.

This is truely a sad day. Our own government will not protect the rights and health and welfare of our state citizens's because of "political correctness" and trying to buy the next election. Even the union members of border patrol agents want Eric Holder to step down for his handling of fast and ferious. The next individual that is killed in Arizona by an illegal alien, after our own government does nothing to stop them entering our country illegally, should be sued by the states and family members losing a loved one. Never in my life have I been more ashamed by our current political representatives for not upholding our precious Constrituion or Bill of Rights.
