Prompted by a Tuesday piece on the front page of the Wall Street Journal on the scary weakening of mens rea (guilty mind) requirements for an action to be considered a crime, here’s my latest column at CFIF, examining a truly frightening trend called “overcriminalization.” Please read it; this is the cutting edge of the fight against truly frightening examples of creeping tyranny.

When entering the Soviet Union on business...it was made crudely clear: "We gotcha any time we want ya'."
See, their entire judicial system was formed around conflicting laws...obey one...automatically break another.

That's where our communists in charge want to take us...and I ain't goin'.

Lawbreaker! you also commit a felony by abstaining from either. I often wonder if the Marxist influence that we see today blossomed from corrupt politician's individual desire for power or was the seed planted in their brains in the 60's by commie USSR.

I believe contributing cause of this has come from the unionization of the government workforce. The police and government employees no longer work for the citizenry but for the unions. This fosters an "us" (government employees) against "them" (citizenry) mentality. The government then creates an expansion of laws, rules and regulations to apply against the "them" to maintain their power and put "them" in their place. For instance the expansion of takings rules under the war against drugs gave the police and government broad powers in confiscating private property under the guise of keeping the drug lords from keeping their ill gotten gains. However it does not take a critical thinking man very long to come to the conclusion that giving the government this power would result in them expanding this power to include mundane misdemeanor infractions or to accuse them of a felony and force them to prove their innocence to get their property back. Takings laws provide the government a revenue stream every bit as diabolical and wicked as EPA or Wildlife confiscation rules or hidden tax mandates. What makes it even more pernicious is that it requires a paramilitary police to maintain the revenue and keep the "them" in line. Because the government employees work for the union they have no moral dilemma with applying or misapplying these laws, rules and regulations against innocent citizenry. For none of the citizenry is innocent because we are "them" and not members of the "us".

These are just more examples of the inflation of our Federal Bureaucracy. Once hired they have to justify their existence. Each bureaucracy then finds a need for a legal staff, an investigative staff and an enforcement staff with arrest powers.

These bureaucracies have reached the point in our Republic that they are the biggest threat to our individual freedoms that exist. In a large sense they are answerable to nobody. Even our elected officials, who had a hand in their growth, are frightened of them.

The only way to get them back under control is by controlling the money that funds them. The House of Representatives should cut their funding by 50%. Each and every one of them! Put half of their staffing back out on the street!

It is a start.
