The truth is, the court said EPA must make a determination whether they are a pollutant. Big difference.

This illustrates either the president's willingness to lie or his incompetency as a lawyer. I'm just a pleb but instantly recognized the falsity of the statement when I heard it. I doubt if any in the MSM will pick up on this despite how important the question is with respect to understanding why the administration felt safe in directing the EPA down the path of a CO2 endangerment finding.

Perhaps with the changes in the senate, Murkowski's approach to reining in the EPA will now pass the senate.

Obama IS NOT A LAWYER! Just attending law school does NOT a lawyer make. There is no evidence that Obama ever passed the bar exam. We are not even sure if he took the required courses or accumulated the necessary credit hours to even qualify for the bar exam.

Obama lied when he took the oath of office, "...to preserve, protect, and defend the Constitution of the United States ..." He and his attorney general Holder are doing their best to undermine the Constitution and the rule of law. Their goal is to leave the U.S. a diminished nation when they leave office. After that, Obama will travel the world condemning the United States. His favorite audience will be Muslims.

There's any number of areas where the new GOP majority in the House needs to tread carefully, but this is one area where Issa and company need to bust wide open the credibility of the EPA, the endangerment finding, and their dependence on unvetted and unreliable outside (IPCC) materials.

Whatever you believe about climate change the facts are that the IPCC process is a joke and the EPA's endangerment finding is a fraud.

The main issue is not that BHO habitually lies, it is that EPA continues its grossly unconstitutional overreach of authority in re-writing the CAA statute which was clearly never intended to regulate GHGs. Cap-and-trade is just a dodge by the left. The EPA is systematically dismantling our fossil-fuel energy infrastructure. When EPA issues its revised PSD permitting rules in 2011, there will be no new or modified major fossil-fuel power generating sources, period. How will any power generator demonstrate an insignificant impact to the environment for any increase in CO2 emissions? It will be impossible to get a permit when trying to battle all the greens. How can a permittee respond to a comment when the science is so grotesquely false? It is the EPA that must be stopped. Somebody please sue them.

Wrong - in Mass. v. EPA, the Supreme Court required EPA to determine if greenhouse gases would harm public health or welfare, not to determine if they were pollutants under the Clean Air Act. To quote Mass. v. EPA, the Supreme Court said "Because greenhouse gases fit well within the Clean Air Act's capacious definition of "air pollutant," we hold that EPA has the statutory authority to regulate the emission of such gases from new motor vehicles."
