Even Democratic Sen. Max Baucus says he is “troubled” by the recess appointment of Donald Berwick to head the Centers for Medicare and Medicaid Services:

“I’m troubled that, rather than going through the standard nomination process, Dr. Berwick was recess appointed.  Senate confirmation of presidential appointees is an essential process prescribed by the Constitution that serves as a check on executive power and protects Montanans and all Americans by ensuring that crucial questions are asked of the nominee – and answered.

Among the statements that Berwick will not have to answer for: “Cynics beware, I am romantic about the (British) National Health Service; I love it.”

Wait a minute! There's some guy on this site named "five things *you* can do" telling me I can do five things to make Obama listen (including not calling the Communist DemocRATS, Communist DemocRATS.) Isn't Obama listening to us? Why would he do this? I better start doing my five things. That will show Obama.

he's only troubled because november is just a few months away. now they're all going to start crying about the things they voted for. just like during the bush years...they voted for it and then pretended they didn't.

I am no Obama fan, but the President has the power to do recess appointments.

Going after Dr. "Death" Berwick is a great idea, but maybe not slam the recess appointment process.

Yes the President does have the power to make Recess Appointments. However, by making this recess appointment, he totally ignored not only normal procedure, but his promise to have a totally "transparent" administration. Not that is really new, look at how health reform was passed. "We need to pass it before we know what it contains."

I gave him three months when he got elected, just to be fair and since he was my president. He ran out of time with me in three weeks.
