The Department of Justice will file suit against Arizona this week in an attempt to overturn SB 1070. The federal government will base its case on preemption, even though Arizona does not create new immigration violations and bases its statute entirely on existing federal law. But this argument is particularly rich:

The filing is expected to include declarations from other U.S. agencies saying that the Arizona law would place an undue burden on their ability to enforce immigration laws nationwide, because Arizona police are expected to refer so many illegal immigrants to federal authorities.

It is precisely the federal government's failure to enforce its own immigration laws -- and their incomplete border fencing that has redirected illegal immigrants to Arizona specifically -- that would account for such referrals. Federal action would have made the Arizona law unnecessary But the Obama-led feds would rather crack down on Arizona than illegal immigration.

Bring it on! Can we all hope that the GOP establishment sees the value in using this in up coming campaign ads and using it wisely? We can't hope that the GOP establishment sees the value in using this suit, since some or many of them aren't too far from the Obama admin's position on the general issue. And, there's a way to deal with cries of racism, but few others are willing to do it. And, referring to "Communist DemocRAT" isn't helping either.

If you want to take effective action, there are five things you can do at my name's link. If even just a few hundred people did one or more of those, we could send a very strong message to the Obama administration and might even force them to drop the suit.

There is nothing, and I mean nothing, that Americans can do to stop the Obama Administration of the Communist DemocRAT party from doing what they wish except vote the scumbags out. Even then they will get a window of opportunity to screw up this country. They are hell bent to remake this country where whites are the minority and the country is socialist. In other words, they ain't gunna listen. They MUST be stopped by ANY MEANS NECESSARY.

The Soviet Union would be more apt. And the Soviets did what they damned well pleased (still do, really). So will the Obama Administration, regardless of your five things. You make a strategic mistake in thinking they care about what you think. They don't. So waste your time doing the five things. I have better things to do with my time.

Obama/Holder can possibly win [politically] even if Arizona prevails in court; since Hispanics will see ObamaDemocrats as being ON THEIR SIDE. With polls indicating that Americans are supportive of Arizona's law [and numerous other states are contemplating passing similar state laws], it is imperitive that Americans make every effort to go to the polls [and persuade their friends, relatives, co-workers, fellow church congregents,etc to do so also] and VOTE against any/all politicians who are politically affiliated with the present administration's policies/programs. This is political war, and true CHANGE has to be made in November and going forward!!!!!

We are witnessing yet another example of left-wing idiots, who hate America, trying to push their sick ideology on this country. Obama is not a president. The only opinion one can reach is that he is a divider, and very close to being an anarchist. I do not hesitate to state my opinion that he is trying to cause irreparable damage to the USA. The House of Representatives of these United States, must intervene on the part of the American people and have this farce of a leader brought into impeachment proceedings to make known his motives. However, this is what you get when you vote for a Chicago community organizer. Just what is it, he is trying to organize? It appears to me he only excels at causing problems. Arizona is to be admired for the stand they have taken. All other states not following this example should be ashamed of not having the courage the patriots in Arizona have to do what is right. America is in peril. Everyone should be rising to the call of "Impeachment" so we can start the process to make things right. Also, the DOJ seems to be in disarray. Thank you again, Obama-ites.

This will be Obama's Waterloo. Only a complete fool will sue a state which has passed a law that in actuality merely says the federal government should enforce the laws it has passed,.... in other words, forcing the feds to do their job.

The downside for us in AZ here is that we will renominate and otherwise RINO Governor who needs to be replaced, just because of 1070. Heck, since she signed this bill even the NRA endorsed her over a fellow on their own national board. Politics is madness.

I agree with you wholeheartedly about the need for IMPEACHMENT, but can't see it occurring with Democrats' numbers in both houses of congress at present [and with the current group of SIT-ON-YOUR-HANDS Republicans]. What is needed [and which I hope and pray will occur] if that a political revolution will develop in the November elections nationwide, which results in a complete overthrow of the current congressinal members and the election of representatives who DO THEIR CONSTITUENTS' BUSINESS and not that of their party bosses'!!!!!!!

Oh please- stop with the wishful thinking. No revolution will occur- it didn't happen for the Democrats in 06 or 08 after Republicans screwed up and it won't happen this time either. Why?

Because most people don't have a clue about politics and it doesn't really affect their lives too much. Yes, the economy is in the tank and unemployment is way up, but people are gonna vote for who they know- that means incumbents.
So yes, Oldefarte. A revolution is needed. But things will have to get a whole lot worse before Americans start voting in the kind of change you want.

Eric Holder and the Justice Dept are charged with upholding the law and looking out for American citizens, however it seems that this errand boy for Obama is now relishing the idea of attacking the very citizens he has been sworn to protect by siding with aliens who are committing illegal actions in the US. Good going. I predict that Holder and others will soon be under indictment themselves for the Black Panther case which is about to hit the fan. Funny how the re-emergence of the Black Panthers case seems to have hurried the Justice Dept to fast track the AZ attack. This is a great way to cause a civil uprising or at the very least a social war.

Why does everyone just assume Arizona would cave after a kangaroo court ruling against them? What would Obama do, roll the tanks to force the state to comply? Would the military really respond to such an order?

Here in brief is the crisis moment. Even without taking one side over the other here, the decisions that follow an adverse court ruling could be the most momentous since about say 1860.

Our best shot at limiting the long-term damage our dishonest and unprincipled president can do to our country lies in maintaining the resolve to repeal as much of his (and of Pelosi's and Reid's) legislation as possible as soon as possible.

Too many are claiming that repeal isn't a reasonable expectation, that once an entitlement begins it's viewed as a complete right that has fully vested in its beneficiaries.

Big deal. This merely means that we need to begin making it very clear, very publicly and very emphatically, right now, that if you've realized some huge underserved gain under Obama - whether I'm now buying your insurance, or your company is now building little green thingies for Obama and getting billions in return, or you've simply become dependent on your annual $5000 check from Acorn for filling out hundreds of fake Democrat-supplied ballot forms - you shouldn't get used to it.

We need to make it clear to all that such crap WILL be repealed, and that anyone crying foul due to the dwindling of their receipt of money stolen from people better and more valuable than them should have known that it couldn't last.

And then we need to object loudly when some senator drags down the repeal process because it will decrease the amount of money his state gets to steal from the rest of us.

Well put, Bobby B. I think we have reached a point where the best we can hope for is to salvage what we can from the wreckage of this administration's overreaching activities. The reason I did not vote for Obama is because of his proudly proclaimed association with socialists, and the Chicago thug politics that propelled him to his current position. Nothing he has done is surprising. What is surprising is the number of people who defend his actions with no thought to the powers given to the president by the U.S. Constitution - you know, that thing he swore to preserve, protect and defend. I'm still waiting for him to get out of campaign mode and behave like a president who cares about all of the citizens of this country - not just the ones who might vote for him next time around.
