In order to protect the new national health care law from legal challenges, the Obama administration has been forced to argue that the individual mandate represents a tax — even though Obama himself argued the exact opposite while campaigning to pass the legislation.
Late last night, the Obama Department of Justice filed a motion to dismiss the Florida-based lawsuit against the health care law, arguing that the court lacks jurisdiction and that the State of Florida and fellow plaintiffs haven’t presented a claim for which the court can grant relief. To bolster its case, the DOJ cited the Anti-Injunction Act, which restricts courts from interfering with the government’s ability to collect taxes.
The Act, according to a DOJ memo supporting the motion to dismiss, says that “no suit for the purpose of restraining the assessment or collection of any tax shall be maintained in any court by any person, whether or not such person is the person against whom such tax was assessed.” The memo goes on to say that it makes no difference whether the disputed payment it is called a “tax” or “penalty,” because either way, it’s “assessed and collected in the same manner” by the Internal Revenue Service.
But this is a characterization that Democrats, and specifically Obama, angrily denounced during the health care debate. Most prominently, in an interview with ABC’s George Stephanopoulos, Obama argued that the mandate was “absolutely not a tax increase,” and he dug into his view even after being confronted with a dictionary definition:
OBAMA: George, the fact that you looked up Merriam’s Dictionary, the definition of tax increase, indicates to me that you’re stretching a little bit right now. Otherwise, you wouldn’t have gone to the dictionary to check on the definition. I mean what…
STEPHANOPOULOS: Well, no, but…
OBAMA: …what you’re saying is…
STEPHANOPOULOS: I wanted to check for myself. But your critics say it is a tax increase.
OBAMA: My critics say everything is a tax increase. My critics say that I’m taking over every sector of the economy. You know that. Look, we can have a legitimate debate about whether or not we’re going to have an individual mandate or not, but…
STEPHANOPOULOS: But you reject that it’s a tax increase?
OBAMA: I absolutely reject that notion.
At the time Obama made that statement, the Senate Finance Committee had just released its own health care bill, which clearly referred to the mandate penalty as an “excise tax.” But in later versions, the word “tax” was stripped, because it had become too much of a political liability for Democrats. The final version that Obama signed did not describe the mandate as a tax, and used the Commerce Clause — not federal taxing power — as the Constitutional justification for the mandate.
“”This is an about face from what is laid out in the law,” said Karen Harned of the National Federation of Independent Business, which joined the Florida lawsuit against ObamaCare. “In the text of the healthcare law, the findings for passing an individual mandate specifically rely on the effects of individuals on the national economy and interstate commerce. Nowhere in the findings is the mandate referred to as a tax. The Justice Department is now calling it a tax to try and convince the court not to rule on whether or not Congress exceeded their authority under the Commerce Clause by legislating that all citizens must purchase private health insurance or face a penalty.”
Put another way, the administration is now arguing in federal court that Obama signed a massive middle-class tax increase, in violation of his campaign pledge.

Its not surprising that Joe Wilson was the one telling the truth when he yelled out "you lie" to Obama during the joint session of congress. I work for a state university in TX and just received info on my new health care plan. Bottom line -- most of my costs are going up including my share for doctor office visits, yearly deductions, perscriptions, and emergency room visits. I'm just bracing for the other shoe to fall and see my monthly premiums going up. So much for Obama's promise that his health care plan will save most people money. Looks like he also lied about this.

The problem with the Obama admnistration's explaination is that a tax is normally levied on something one purchases or owns; the HCR compels someone to buy something (health insurance) or pay a fine. I cannot imagine a 1st year law student who would use the language the DOJ is now using and expect not to be thrown out of law school.

Great! The government is finally admitting that the HCR law is unconstitutional!
The 16th amendment gives the government the right to levy income taxes - the individual mandate is not an income tax, it is a capitation.
The Constitution clearly states that capitations must be "in proportion to the census". Obama's healthcare bill specificly omits coverage of illegal immigrants - there is no way they could have passed the bill without doing so - yet the census does include illegals.
So, there is no way that the individual madate "tax" can be proportioned to the census - therefore the tax is unconstitutional, and thereby the whole law is unconstitutional!

Don't forget also that tax bills must originate in the House. This bill (famously) originated in the Senate. House members had to be bribed to vote for the Senate version on the promise that the Senate would "fix" the bill after the House passed it.

I've already written Roberts and other members of the Supreme Court as well as the White House. I told them all that I will never submit to this and the IRS and Obama can go to Hell. Well, I've become a vocal voice to my representatives in D.C. Thankfully, one of them has his head on right and seems to still care about this nation. I support the American Center for Law & Justice (ACLJ) as they battle for our rights on many fronts, including this one. I write to the White House weekly; and, yes, I realize they probably just delete and/or shred what I write. I do it anyway. I am taking a Constitution class. I am educating myself in order to be able to intelligently defend my nation. I tell all those who will listen about the atrocities, the irresponsibility, the hyposcrisy, the puppet Administration who is pushing this radical Progressive agenda. I write letters to the Editor in an effort to get others engaged and thinking. I go out and protest whenever possible. But the IRS gets to collect a "Fine" if you can't prove you have government approved health insurance coverage? Then why isn't there a mechanism for them to collect the Individual Mandate as a tax in the first place - a withholding?
The Individual Mandate is Unconstitutional - The Government can't force American Citizens to buy anything from the Private sector - any product for that matter, which is what Health Insurance is by definition.
The Untied States Congress gets to regulate commerce, they don't get to force commerce on citizens.
I can't believe all these Lawyers - holding Government offices, didn't see this challenge taking down their highly unpopular legislation.

The Constitution for the USSR had some very nice words about freedom of the press, speech, and right to assembly. And those words on paper did little good once the tyrants were in power.
If people won't stand up for their rights they will lose them. I don't mean it has to be crazy stuff like violence. I mean work with political organizations, state your views fearlessly everywhere, donate time and money to campaigns and legal funds, boycott when needed, etc., etc. Support those who have strong enough opinions to be civilly disobedient as well.

Lets make it easy - there is evidence that Obama is not a "legal" president since there is no valid proof that he is a U.S. Born Citizen - his exuctive seat, all of the bills he has signed (ObamaCare), all of the phony czars and other appointments he has made are thus legally "void and null". He is in line for an impeachment. His handling (or mishandling) of the BP Oil Spill is evident that he cannot lead, cannot make decissions on demestic problems and proof that he should not hold office of this christian (not Muslum) founded country. If the government can force you to buy something you don't need and don't want, i.e. engage in forced commerce, under the coverage of "interstate commerce" or you must pay a tax, penalty or fine (whatever they choose to call it) then the government can force you to do anything, and we might as well shred that parchment in the National Archives with Jefferson's signature right now.

We are arguing about the definition of something. I look up the term in the dictionary (to prove your assertion about the definition wrong) and you get indignant saying I must be stretching, (ie there is no merrit to my argument), if I have to resort to look up the term in the dictionary. WOW! We've never had a president even close to that duplicitous.

In a 1922 case, the US Supreme Court already saw through the ploy of calling such things a "tax".
In Bailey v. Drexel Furniture Co. (1922), the Supreme Court reviewed a federal excise tax on profits from sales of child-made products. The Court said “the so-called tax is a penalty to coerce people of a State to act as Congress wishes them to act in respect of a matter completely the business of the state government under the Federal Constitution” (p 39), and:
"…Grant the validity of this law, and all that Congress would need to do, hereafter, in seeking to take over to its control any one of the great number of subjects of public interest, jurisdiction of which the States have never parted with, and which are reserved to them by the Tenth Amendment, would be to enact a detailed measure of complete regulation of the subject and enforce it by a so-called tax upon departures from it. …such…would…break down all constitutional limitation of the powers of Congress and completely wipe out the sovereignty of the States." (p 38)

Article I, Section 7 of the Constitution provides that ALL bills for raising revenue SHALL originate in the House of Representatives. The bill that Obama signed originated in the Senate and then was voted on by the House, exactly backwards. Since even the administration is now using the word taxes, i.e., "raising revenue", it has admitted that the bill is unconstitutional. Unfortunately, I don't expect the courts to do anything about it. Look for rulings about the plaintiffs' "lack of standing", the words courts use when they don't want to be bothered.

This guy can't even talk without fallacy. No...his critics are not saying that he is taking over EVERY sector...the fact that he's taking over ANY sector is against the spirit of this country.
