I’ve been reading through young Elena Kagan’s most
impressive senior
thesis on early 20th century New York socialism. What a loss
to the history profession that she did not continue in this vein.
Such easy, clear command of material and felicity in presentation
is rare to come by.
As for those who insist her interest in socialism betrayed
no real sympathy for it — most recently Dave Weigel, the
Washington Post’s leading scold of America’s right-wing
— wishful thinking aside, they may be ignoring a real giveaway
in her thesis, where time and again she tries to correct
impressions that socialists were only marginally significant.
Instead, in her view, a socialist party “whose program and
ideology were winning over increasing numbers” was done in mainly
by its internal divisions, by its “failure ever to achieve
internal harmony.” To me that comes across as a lament — “an
expression or feeling of grief,” according to my dictionary. And
one only laments when what one hoped would happen did not.
By the way, Kagan may not have been up on her Russian
history. The first mistake I’ve noticed comes on page 20 of her
thesis, in this sentence: “In Russia, a very
few had enrolled in
People’s Will, a
terrorist group that
could claim responsibility for Czar Alexander
I’s assasination [sic].” The pre-spellcheck
misspelling aside, the czar assassinated by People’s Will was
Alexander II, in 1881. Alexander I died in 1825, of causes
unknown. You’d think Kagan would have had a greater sense of who
freed Russia’s serfs.
On the other hand, maybe she did have some sense of Russian
history. The very title of her senior thesis —
“To The Final Conflict: Socialism
In New York City,
1900-1933” — is an unmistakable play on the title of
Edmund Wilson’s classic, sympathetic study
of socialism’s rise and its culminating with Lenin’s return
to Petrograd’s Finland Station in 1917. Talk about a
giveaway.

What should disqualify her from becoming a Supreme Court justice is that she argued in front of SCOTUS, last September, that Congress could ban pamphlets.
6 months before that, an assistant in her office argued, in front of SCOTUS, that Congress could ban books.
Also, as far as I know, she hasn't spent much time in a court room. Her lawyer skills are probably mediocre. It should not be that hard to trip her up during the confirmation hearings.

I think she could have gotten a lot of that thesis from the information in the book "World of our fathers" by Irving Howe. It describes jewish immigration, mostly in NYC and how they formed and led the socialist movements of the time.

Kagan wasted valuable resources and time by taking this case all the way to the Supreme Court while we were fighting TWO wars--which proves she lacks proper judicial judgment.

I strongly believe that a market-based economy generates more wealth and human goods than any other system, but I believe its very creative power is also the source of societal volatility and instability that the government can and should redress by means of the democratic process.
I also believe that markets are thoughtless about the future, so societal institutions -- again, with some limited help from the government -- need to coax, inhibit, and guide markets so they don't put undo pressure on families, traditions, and cultural goods (opera, say).
I believe the United States of America has it right. Our Constitution is a master piece of political thought, unsurpassed in world history. Our judicial system is nothing short of a miracle. For thousands of years men were subject to the law and had no redress or rights before it.
The Founders were men of the Enlightenment. They did NOT imagine the Constitution would be read only in accordance with "original intent." Nothing would have been less likely to be their intention.
Indeed, for men of the Enlightenment, the Great Books WERE LIVING DOCUMENTS.
The Founders did not imagine any schmuck perusing the Constitution and developing an opinion about what it literally means.
The Founders believed the Constitution would be read and interpreted by thoughtful men who were IMMERSED in the works of Plato, Aristotle, Cicero, Machiavelli, Hobbes, Montesquieu, Locke, and Rousseau. I assure you, these men did not believe in a slavish obedience to something so cardboard as the "originalism" propounded on the right today.
