Senate Minority Leader Mitch McConnell just released this statement:

“John Paul Stevens has said that he never felt the need to break any records, but judging by his legendary vigor it seems highly likely that he could have shattered the record for longest-serving Supreme Court justice if he had wanted to. I commend Justice Stevens for his lifelong commitment to public service, from his early days fighting corruption in Chicago, to his work in naval intelligence during the Second World War, to his more than three decades on the nation’s highest court. Even if Justice Stevens’ liberalism has led to many decisions I oppose, I respect his devotion to the institution and the gentlemanly manner in which he always carried out his work. I wish Justice Stevens and his wife Maryan all the best in their future endeavors. 

“As we await the President’s nominee to replace Justice Stevens at the end of his term, Americans can expect Senate Republicans to make a sustained and vigorous case for judicial restraint and the fundamental importance of an even-handed reading of the law.”

Enough rethoric.

Obama is a Socialist period.

You don't do a vigorous debate...you block any of his appointments period.

Then in January of 2011 Obama won't have the Senate majority to confirm his Socialist choices for the bench.

This is not rocket science Mr. McConnell, but it does require the political gloves to come off and fight this Chicago mob toe to toe and on C-Span.

The Answer is, STALL and Replace No one until 2013.

The Tea Leaves (pun intended) said that come January 2011, the House and Senate will be firmly in control of the Republican Party.

The institutional reality is that there is no Constitutional requirement for 9 Supreme Court Justices. The Constitution stipulates only ONE judge and one Court. All others are creatures of Congress.

So, the reason for the rush in confirming a Leftist replacement for Justice Stevens is pretty simple. A Republican controlled Senate doesn't have to filibuster any judicial nominees, even to the Supreme court. The Court would remain at 8 members, hear cases, and issue rulings.

The Stevens departure leaves the Supreme Court at 4 Conservatives, 3 Libs, and one Mush-pie who leans right more than left of late. If Ruthie bows out within the next three years, that leaves it at 7 with 2 Lefties in the mix, and then the Mushie middle is irrelevant.

The question is, does someone with a cool head and the character to implement strategy instead of suck up for phony comity?

The GOP needs to stall the Stevens replacement until after the November elections, work to win those elections, and then keep the Lame Duck session from ever occurring.

BTW... that is an issue that y'all really need to consider. If the GOP wins the way it is looking like they will win in November, and takes control of both Houses of the Legislature, this is likely to be the most Dangerous Lame Duck Session of Congress in the history of the United States.

Yes, TMF, when you read the Tea Leaves, you will see that we on the Right Side do have the power.
Stoophead just resigned today and there will be more who will step down.
What we need to do is lean heavily on the members of the Judiciary Committee and let them know that a "YES" will not be tolerated under any circumstances.
Jeff Sessions will carry the ball followed by John Kyl and possibly Orrin Hatch. The rest are "maybes".

McConnell's bluffing. Most Republican senators are either cowards or doormats and often both. Obama could nominate Eric Holder or Lani Guinier and half of Republican senators would vote to confirm him or her. The succesor to Stevens will win at least 75 votes for confirmation.

I concur with Derek. There is no spine in the GOP Senate.

This is a prime example of why the Senate should not be popularly elected. We don't need demi-gods who loot the treasury jsut to get along anymore than we need The Kenyan as our POTUS.

Will Sotomayor recuse herself if The Kenyan's lack of being a natural born citizen ever makes it to HER wise latina court? I doubt it. That will be an interesting spectacle in itself.

Let's see, does that mean Republicans won't say "God Speed" as they vote like sheep to allow Obama's radical pick to take her seat?

Maybe they'll pull out the heavy guns and refuse to blow their usual kisses to the "dignity of the process" and "any president's right to seat his own nominees" as they vote in unison to confirm.

I know! Maybe they'll insist that Mr. Obama apply a little lubricant before he next rapes this country.

Yeah, I'm real, real impressed.

Last Summer Dick Lugar (D-In) was the first GOP Senator to rush to the mic and announce his endorsement of Sottomeyer. It was up on his website for months.

The President could nominate Charles Manson, and I bet a dozen GOP Senators like Lugar would gush thier praises.
