1. Decisions based on the letter of the law that don't reach the
desired policy outcome or defy "common sense" are "activism."
2. Lily Ledbetter really got shafted, once you omit certain key
facts of her case, ignore existing provisions in the law that
reset the clock on statutes of limitations, and grant that
companies should be unable to defend themselves against
discrimination lawsuits by allowing people to sue for the alleged
discriminatory actions of supervisors who are dead. (The first
two lessons come from Sen. Dick Durbin.)
3. Jeff Sessions and Tom Coburn seem to be the only Republicans
on the Senate Judiciary Committee.
