Not one to mince words, here's what Rush had to say on Sotomayor:
She is a horrible pick. She is the antithesis of a judge, by
her own admission and in her own words. She has been overturned
80% by the Supreme Court. She may as well be on the Ninth
Circus Court of Appeals, given all the time she's overturned.
She has been reprimanded by a truly strong Hispanic judge, Jose
Cabranes. She has been rebuked in writing by Cabranes for
opinions that she wrote that had no bearing on the
constitutional issues before her in the case that was being
decided. Details on that coming up. But here is why, even
though she may not be able to be stopped, here is why Sonia
Sotomayor needs to be opposed by the Republicans as far as they
can take it, because the American people need to know who
Barack Obama really is, and his choice of Sonia Sotomayor tells
everybody, if we will tell the story of her, who he is.
He got up in his announcement and said everything about her
that isn't true, that she's a great constitutionalist; that she
doesn't use personal opinion; that she understands what her
role is and the oath is of a Supreme Court justice. She has
done just the opposite of that. She is a hack like he is a hack
in the sense that the court is a place to be used to make
policy, not to adjudicate cases, not to adjudicate
constitutional law but to make policy.
The test is whether or not Republican leadership will aid in the
crucial hearings in a way that adequately shows who this woman is
as a judge. They have to do this skillfully, without looking like
they're just out to stop Obama's pick because she's Obama's pick.
And they have to do it without worrying about the Hispanic vote.
Sadly, they'll make a half-hearted show of having the mildest of
reservations and then roll over - like they always do.
Limbaugh is right alnd Powell (et al) is wrong: This chasing of
victim group votes (in this case Hispanics) is one gigantic
surrender to the entire premise of liberalism.
And it never works for Repubs anyway (see 2008 election returns).
We no longer have a two party system in this country. We have
internecine squabbles within the Party of the DC Cocktail
Circuit.
This is going to be nauseating.

I couldn’t agree more with Rush if I wanted to. I’d only add (and
it’s probably already assumed in Rush’s statement) that
Republicans should be prepared, when being tagged as
anti-Hispanic or racist, to hammer home, right away with Ricci.
In fact bring him and other plaintiffs in the case to the
hearing. Spreading the word, bringing in the deaths of 300
firefighters who lost their lives on 9/11, and who lost those
lives for all races and creeds.
They should also bear in mind (as a matter of strategy and
tactics) that there is an inexorable logic, however faulty or
malign, that sees redress or reparation as restitution and not
activism.
TNR had a piece recently that claimed several non sour-grape
colleagues and clerks find her intellectually unimpressive. I’m
not saying she is. Her undergrad achievement is Summa. Also, she
impressed Moynihan who I don’t’ see as lobbying on her
unimpressive behalf. But if her reversal rate is as high as 80%,
she's gotta have some problems that will jump when reviewing the
reversals in detail
Here’s the thing that will give every liberal re-flux: if she
really is unimpressive and becomes the Quayle of the Court. No
offense to Qualye meant. I’m speaking of public perception. She’s
going to be compared to Saclia first, then probably Ginsburg and
Breyer. But Ginsburg and Breyer are not presented as the heft of
the Court. Scalia is the name above all others on the Court.
Liberals would hate nothing more than their girl/guy becoming an
embarrassment of intellectual poverty as compared to Saclia and
others, both left and right.
I know elections have consequences, but it’s easy to revel in
what might have been while forgetting that it was Nixon who gave
us Blackmun.
Depending on her writing abilities as pertains to the law or lack
thereof, she might force other members to be squeamish about
being associated with her judicial rationale and push the Court
not so much in the direction of Scalia, Roberts and Alito, but
nowhere near her true north.
Rush understands that this represents an educable moment for the
Country.
Republicans have nothing to lose and possibly something to gain
by opposing her as far as they can, and really looking at the
situation as Rush has advised: as an educable time for the
electorate. The electorate, right now, may not care, but
Republicans have a duty to record this for posterity, and to do
it extremely well showing the greatness of our Constitution with
reverence and affection.

Not that I'm in any way surprised, but Obama certainly seems to
be swinging for the fences. While I am generally happy with
Roberts and Alito (for now...), those two are in no way as
"conservative" or "originalist" as Sotomayor appears to be
"liberal" or "consequentialist". It will be a sad commentary that
the media will most likely praise Obama for his noble choice and
villify Republicans for even considering questioning the
credentials of a LATINA WOMAN, as compared to when Bush
nominated two relatively moderate jurists (relative to Scalia
& Thomas) the media would have had everyone believe human
"progress" was being set back 200 years. The applied double
standard shouldn't even be worth noting were it not
unapologetically applied to basically everything Obama does.

citizen is to be considered EQUAL under the RULE OF LAW??? Wasn't
this part of the whole point of breaking away from monarchical
Britain - that some people carried privileges of exemption from
the law while others experienced heavier legal burdens? The
correct thing to say would be: It is the case that
by qualifying our differences... we do a disservice both to
the law and society..."
