The Obama Watch

His Biggest Big Lies

Good morning, suckers: President Obama is playing you.

If you work hard, play by the rules, save your money, create jobs, and make a success out of yourself, President Obama and the Democrat party will plunder everything you have worked so hard for, because in their view that is only fair.

That is the meaning of the policies President Obama is espousing as he campaigns for re-election around the country this week. As Mark Steyn has explained, there is no bill yet that the President is demanding Congress pass, it won’t create any jobs, and there is no money to pay for it. It is just a traveling road show, and we need to start to hold accountable our relatives, friends and neighbors who would fall for it, and thereby darkly threaten the entire future of America.

Calculated Deception

Campaigning for re-election on Monday, President Obama said,

Middle-class families shouldn’t pay higher tax rates than millionaires and billionaires. That’s pretty straightforward. It’s hard to argue against that. Warren Buffet’s secretary shouldn’t pay a higher tax rate than Warren Buffett. There is no justification for it. It is wrong that in the United States of America, a teacher or a nurse or a construction worker who earns $50,000 should pay higher tax rates than somebody pulling in $50 million. Anybody who says we can’t change the tax code to correct that…. They should have to defend that unfairness — explain why somebody who’s making $50 million a year in the financial markets should be paying 15 percent on their taxes, when a teacher making $50,000 a year is paying more than that — paying a higher rate. They ought to have to answer for it.

Let me educate you, Mr. President, even though I am quite certain you are not interested in hearing any answer that contradicts your committed religious beliefs. But the truth is that the unfairness you discuss is a fantasy. The facts are just the opposite.

Even before you were elected, Mr. Obama, under the tax policies adopted by President Reagan, House Speaker Newt Gingrich, and the much vilified President George W. Bush, official IRS data for 2007 showed that the top 1 percent of income earners paid more in federal income taxes than the bottom 95 percent combined! The top 1 percent of income earners that year earned 22 percent of income but paid 40.4 percent of total income taxes. When Reagan became President, the top 1 percent paid 17.4 percent of income taxes, as I note in my recent book, America’s Ticking Bankruptcy Bomb. As Jack Kemp used to say, if you want to soak the rich, cut tax rates. Moreover, the bottom 40 percent plus of income earners now pay no federal income tax on net as a group.

So if “the rich” are not paying their fair share, Mr. President, what would that fair share be? Based on these official facts, for you to run around the country telling America that we could have jobs and balance the budget and solve the debt crisis you are creating if the rich would just pay their fair share of taxes only demonstrates that you are not qualified to be President. Either you don’t understand the basics of America’s tax policies even after you have been President for three years, or you are engaged in calculated deception thinking your fairy tale will fool enough gullible people that you can be re-elected despite an economic record so bad that it is threatening to rival the Great Depression.

As the Wall Street Journal further explained yesterday, in 2008 official IRS data shows that taxpayers earning over $1 million paid an average federal income tax rate of 23.3 percent. Those earning between $500,000 and $1 million paid an average federal tax rate of 24.1 percent. As the Journal further elaborated, “that is more than twice the 8.9% average rate paid by those earning between $50,000 and $100,000, and more than three times the 7.2% average rate paid by those earning less than $50,000. The larger point is that the claim that CEOs are routinely paying lower rates than their secretaries is Omaha hokum.”

Actually it is a Warren Buffett scam. His company that made him rich, Berkshire Hathaway, itself is a sophisticated tax shelter. If tax rates are raised, that will only lead more of the wealthy to flee to investing in his company to avoid the abusive multiple taxation. The IRS claims that Buffett’s company owes a billion dollars in back taxes. If Buffett thinks the rich don’t pay their fair share, why is he fighting this? Why doesn’t he just pay his fair share as required under current law?

 Buffett is just playing all of us like President Obama is. What a disgrace that our public debate has fallen this low, to this level of rank, manipulative dishonesty.

And the above doesn’t even count the corporate income tax. America suffers from virtually the highest corporate tax rate in the industrialized world, nearly 40 percent on average counting state corporate income taxes. Even Communist China has a 25 percent corporate rate. The average rate in the European Union, which is reputedly mostly socialist, is even less than that. In formerly socialist Canada, the corporate tax rate is 16.5 percent, slated under current law to fall to 15 percent next year. Compared to America, Canada has been booming since Obama was mistakenly elected.

The Obama/Buffett ruse arises just like any other magician’s trick. It focuses attention on just one tax rate paid on income arising from capital investment — the capital gains tax rate of 15 percent. The florid abusive rhetoric distracts from the multiple taxation of that income, which is actually taxed at least four separate times under our tax code. Capital investment income is taxed first by the above mentioned, abusive, internationally uncompetitive corporate income tax. If any is paid out as dividends, then it is taxed again by the individual income tax. If the value of the capital interest, say a share of stock, manages to increase in the Obama depression, then it is taxed again by the capital gains tax. If anything is left at death, then it is subject to taxation again by the death tax.

Moreover, a basic principle of our tax code is that any business expenses incurred to produce income are deductible in the year they are incurred. But not the expenses of capital investment. Those expenses can only be deducted over several years under depreciation rules, which is yet another form of discrimination and plunder of capital investment. Moreover, the money devoted to any capital investment has already been taxed when it was earned, so that is effectively still more taxation of the same income.

That is how the top 1 percent of income earners ends up paying more than the bottom 95 percent combined. And it is why the average tax rate paid by millionaires is three times the average rate paid by the middle class.

The IRS claim is against Bershire Hathaway rather than Warren Buffett. Berkshire is a public company with a fiduciary duty to manage shareholder assets. The correct business decision is to make the IRS demonstrate in court that tax is lawfully due. If Buffett simply agreed to the claim, then he might be unfairly delivering other people's money to the government. Buffett should be encouraged to give his own money to the government rather than that of others.

I love the opening paragraph. There is a fundamental problem in this country that is being encouraged by liberalism. That problem is the avoidance of that little commandment; "Thou shalt not covet thy neigbor's goods".

I see a huge number of Marie Antoinettes sitting on their hands while waiting for their knight in shining armour to come cantering up on his charger. This mythical character might yet appear. If Obama were serious about the rich paying their "fair share" he would excoriate Buffett (whose currently fighting the IRS not to pay his fair share) and other Democrat tax cheats like Nancy Pelosi, Harry Reid, Barbara Boxer, John Kerry . . . You get the picture.

In particular rich Democrats Barack and Michelle Obama could easily pay more taxes if they weren’t so intent on cheating the system. Here is how.

1. Do not utilize itemized deductions.
According to the 2010 Obama personal tax filing, Barack and Michelle Obama claimed $373,289 in standard deductions. Instead of claiming all these deductions, the Obamas could have simply selected to utilize the standard deduction ($11,400 for married couples), thereby boosting their taxable income by $361,889.
By utilizing this strategy, they could have paid an additional $126,661 in 2010 income taxes (utilizing a 35% marginal tax rate).
2. Do not place any money into deferred asset accounts including 401Ks, IRAs, Self-Employed 401Ks, SIMPLE or any other retirement type account.
In 2010, the Obamas contributed the maximum of $49,000 into a Self-Employed 401K. By utilizing this strategy, the Obamas successfully managed to avoid $17,150 in 2010 income taxes.
3. Do not recognize capital losses.
The Obamas managed to take the maximum capital tax loss deduction of $3,000 in 2010. If the Obamas had not recognized a long-term capital loss at some point in the past, they could have paid an additional $1,050 in 2010 federal taxes.
4. Do not utilize the Foreign Tax Credit.
Given that President Obama is hypercritical of U.S. multinational companies for holding assets overseas to avoid high U.S. corporate tax rates, it's almost hypocritical of the president to utilize the Foreign Tax Credit on the individual Form 1040. But that is exactly what he did -- to the tune of $22,215.
If the Obamas had utilized these four simple tax maximizing strategies, they could have paid an additional $167,076 in 2010 federal taxes.
This number would have more than offset the $69,050 they "saved" thanks to the Bush 4.6% marginal tax rate cut on incomes over $200,000.

I wish I could talk to Warren Buffet to tell him that if he feels guilty for paying less of a % than his secretary perhaps he should fire all of his tax accountants that he pays large salaries. Then he can stop taking all those deductions. Just because they are there doesn't mean you HAVE to take them. Once that is done if he still feels guilty, break out his checkbook and write a nice fat check to the treasury to cover his guilt. Problem solved.

What is most disheartening about all this is that there are amongst us still people who believe in this "soak the rich" kill the golden goose type of redistribution. The rich are not rich because we are poor they are rick mostly because of a lot of "luck and pluck".

What about the gap between the best baseball players and utility infielders? That's been following the same trend.

The goal of an economy should not be equality of outcomes, but growth in median income. The only way this can be achieved is by growing the economy, which requires investment.

The investment climate in the US is very poor. Companies have no idea what employment costs will be two years from now, so hiring is mostly frozen and further reductions are likely planned.

There is no way to know what tax rates will be even 18 months out, so return on investment is impossible to calculate.

When you are too interested in "spreading the wealth around", rather than encouraging investment, the wealth goes in hiding.

Of course the problem with increased investment from the liberal perview is that the rewards aren't equally distributed.

Of course neither is the baseball talent.

Classical economic principles suggest that changes in tax rates that encourage investment will result in positive economic developments.

Everything Obama has proposed suggests changes that discourage investment. Look at the tax changes in Obamacare to start with.

There is no guarantee that a business will make money by expanding. They must take a risk. In order to determine whether the risk is worth taking, they must calculate an expected return on investment.

This is the step that is impossible in this environment.

There is no way to know what taxes will be, let alone employment costs in the next 18 months.

I worked for ten years for a virtually one man business. Two including me and a few sub-contractors that would do the tuffest grunt work.

The owner did do 95% of the work himself, though.
I ran the office and was the everything else part of the business. Secretary, book keeper, scheduler, estimate giver, PR manager. et al.

He existed this way from 1985 and as far as I know is still in business. The point of this all is to say that, I don't know how he did it!

Why? Because it was in New York City! When he chose to become Incorporated, everything went up. I remember having to pay all kinds of fees and taxes for all kinds of things. Every time we'd turn around there were more of them.

This was a small, small business. The government works against you at every turn to punish any kind of success. It's a huge gamble and no, success isn't guaranteed. But just imagine the prosperity and greater success small businesses could have if our government thugs (and that's what they are while they steel almost all of your money) would stay out of our way and LET it happen!

Yes, they do. Imagine you're unemployed. You have no income. How much are you able to spend? Now imagine you get a small unemployment check. What are you going to do with that money? Put it in a savings account? Buy bonds? No, you're going to buy necessary goods with it. Things like food and gasoline. That creates demand. Forget economics-that's just common sense.

Unemployment checks are determined to be much smaller than the former employees former wage. So while unemployment checks do create some demand, they creat FAR less than the recipient's former pay.

AND since the unemployed person does not create any useful product in exchange for the unemployment check, there is no profit for anybody including the tax man gained from the money received as unemployment "compensation."

But you forget how many small busniess owners are LLC's. They pay the taxes on their business as part of their personal income, hence they go over the 200-250K limit and run smack into Obama's tax the rich plans.

Then as another poster stated, add the Obamacare taxes for each new employee, along with the increased regulations placed on them, the inflation and increased cost of goods looming over them and you wonder why they are not hiring?

I know Obama wants to give them a one time tax break for hiring vets, which may equal a couple of thousand dollars (one time benifit) in return for the small business owner shelling out many times that for that employees wages, health care, ect.

And you expect him to spend more money than the tax break he will get? I can't follow that logic.

The reason for the gap in income disparity is: Government. When Congress trashes the Constitution and assumes powers never delegated, then that creates a black market of defensive lobbying by businesses hoping to be left alone or to rent seek for their unconstitutional goodies or roadblocks to their competitors (think Solyndra -- a billionaire bundler gets richer off our tax dollars without doing any work). This is why Washington DC and the Virginia suburb surroundings are the wealthiest real estate in America. Lobbyists, lawyers, consultants, and the like make an obscene amount of money pulling the levers of power.

The second reason is our monetary policy of deficit spending. In order for Congress to avoid the electoral suicide of cutting entitlements or raising taxes, the Fed obliges them with a fractional reserve policy that allows banks to take a depositor's real dollar and turn it into ten dollars of vapor money (aka 'reserves'). This vapor money is handled by Wall Street which in turn creates investment vehicles that go out as construction loans, mortgages, IPO's etc. Wall street gets their cut as this vapor money moves about, creating very wealthy investment bankers, hedge fund managers, and stock brokers.

You want an example? Rahm Emanuel "earned" 18.5 million dollars over 30 months with Wasserstein, Perella & Co. using polical clout to keep this vapor money coming their way. How many doctors make this kind of money in that time frame? Jack, if that ain't your poster boy for income disparity, I don't know what is.

Next: combine government social tinkering into the mix with Affordable Housing and the plot thickens. By forcing banks to make loans to those who otherwise could not afford a mortgage, the housing market's natural demand was tinkered with. More people entering the market means the prices climb, enticing more purchases and eventually attracting the investor class. As the housing prices soar through the roof, the toxic loans backing the housing market takes on value. Wall Street now comes up with the "derivative", a bundle of worthless loans that has the (wink wink) backing of the federal government via Fannie Mae. Fannie now buys these derivatives and rebundles them for sale to another batch of investors. The directors of Fannie get their cut, or commission, and they, too, join the ranks of the new millionaire class.

So, Jack, is it healthy public policy for government officials to become millionaires selling worthless paper? Franklin Raines, Jamie Gorelick, et al., became very rich millionaires in a few short years doing what is, frankly, activity that would put an Enron executive in jail (ahem).

And what happens when the housing bubble collapses as working people cannot afford the entrance fee to a starter house? The whole house of cards collapses as that money was fractional reserve vapor to begin with. But the new millionaire class cannot have their vapor wealth evaporate for the political class depends on their contributions (where do you think all these people get all this money to give to, for example, environmental groups?). So what happens? The government takes our hard earned cash, renames it TARP and bails out these vapor money handling institutions -- just to protect the lifestyles and status of the Ruling Class.

So there is you answer, Jack. I'm sure it is something you never expected.

There is an important point buried in this article that everyone should agree upon - that it makes zero sense that those making over $1M pay less % in taxes than those make $500k to $1M.

Quoting from the article quoting from WSJ:

" in 2008 official IRS data shows that taxpayers earning over $1 million paid an average federal income tax rate of 23.3 percent. Those earning between $500,000 and $1 million paid an average federal tax rate of 24.1 percent. As the Journal further elaborated, "that is more than twice the 8.9% average rate paid by those earning between $50,000 and $100,000, and more than three times the 7.2% average rate paid by those earning less than $50,000."

I would be interested to see what those "super rich" making between $250k to $500k (yep, that includes me) pay on average.

Anything less than 10% seems OK to me - regardless of tax bracket, so the $50k under crowd is fine.
Around 25%, maybe even a tad higher for those over $1M, seems fine.

But the fact that over $1M pays a lower % than the $500k to $1M is proof positive that the current tax code is garbage - AND that the complexity favors the "super rich" over the upper-middle class to upper class.

So, the answer is easy - simplify the tax code to fix the inequity that is undeniable.

If that is not possible, or not feasible, go to a flat tax - NO deductions for anyone.

If that is not possible, or not feasible, go to the fair tax.

Unless you are going to eliminate it (ie., fair tax), do not mess with the capital gains rate - a stock market crash will not be pretty.

As a Christian are you not supposed to emulate Christ? Please cite Christ's behavior that mirrors yours. Where did he call people names? Where did He accuse and call out others' sins to the multitude? Where did he condemn people to Hell?

Christ spent His time on this earth teaching with love, patience, and forgiveness. You do not seem to show a much of those qualities.

The problem is definitely a clear, understandable message. NerObama constantly throws one message out to the MSM and thereby his masses: "Tax the rich, millionaire, and billionaires and make them pay their "fair share"." That is about as much as the sheeple in the US can absorb. The conservative message must be as short and concise as possible to counteract it. Simply saying "NerObama Lies" is not going to get through the the allegations of racism that the MSM and the POTUS will toss out. The message to hammer home is that the middle and upper classes already pay more in taxes to support the bloated government. Do not even go into those who do not pay taxes (as much as we know about them) because then it will seem like conservatives are declaring class warfare.
