On administrative amnesty, the Obama administration tells La Raza, "Yes, we can!"

Speaking to the National Council of La Raza in July, President Obama told his restive audience that he was bound to enforce the country's immigration laws and couldn't change them without congressional approval. In response, the crowd chanted, "Yes you can, yes you can!"

La Raza apparently changed the president's mind, because according to an August 18 letter from Homeland Security Secretary Janet Napolitano, yes he did. Napolitano informed Senate Majority Leader Harry Reid and 21 other senators that DHS was focused on removing only illegal immigrants who were violent criminals, convicted felons, or repeat violators.

Additionally, the administration will individually review the cases of over 300,000 illegal immigrants already in deportation proceedings to make sure that they are in line with the new enforcement priorities. That means some will not only be let go but also be given work permits.

Many of those getting a pass would have been amnestied by the DREAM Act, which Congress has repeatedly defeated under both Democratic and Republican majorities. "The President has said on numerous occasions that it makes no sense to expend our enforcement resources on low-priority cases," Napolitano wrote, such as the DREAM Act's more sympathetic poster children.

Yes, he can.

In June, the head of Obama's Immigration and Customs Enforcement (ICE) agency sent out a memo highlighting all the factors that should be taken into consideration when exercising prosecutorial discretion in immigration cases. Critics blasted the document as an announcement that the federal government was going to effectively stop arresting entire categories of illegal aliens.

This summer's moves follow repeated leaks of documents showing that the bureaucracies charged with immigration enforcement had discussed administrative alternatives to "comprehensive immigration reform" -- that is, ways to advance amnesty through the executive branch. Describing these documents as mere brainstorming sessions, DHS representatives have only denied that they would use their discretion to amnesty the entire illegal immigrant population.

In her letter to Reid and company, Napolitano continues to advocate the passage of the DREAM Act, noting that the new policy "will not provide categorical relief for any group." DHS is well within in its rights to set enforcement priorities, and the removal of criminal aliens is a logical place to start. Prosectuors also need a certain amount of discretion. But these tools should not be used to bypass Congress and set policy.

Napolitano wrote that over 50 percent of the illegal aliens deported in fiscal 2010 were convicted criminals. More than two-thirds of the remainder were either apprehended at the border or were "repeat violators of our immigration laws." The secretary said they aim to continue this trend.

This explains a seemingly contradictory policy where the Obama administration has been simutaneously pushing the Secure Communities program against liberal opposition while also suing states that enact laws like Arizona's SB 1070. The first focuses only on criminal aliens in local custody. The latter targets illegal immigrants more generally, and the White House is signaling that simply being in the country illegally is no longer sufficient grounds for removal -- or at least not a priority.

"Both the nature and timing of the decision suggest that presidential politics is at play here," Wendy Schiller, a Brown University political scientist, told CNN. "Obama has lost ground with his liberal base… and he absolutely needs strong support in states with large Hispanic populations to keep the White House for four more years."

That's why the administration quietly let the new policy slip while Congress was out of town and the president was on his way to Martha's Vineyard.

Play immigration politics as a Democratic get-out-the-vote effort in 2012? Yes, he can.

To be blunt, with a lousy economy (except DC and NYC, where the "elites" live), there is little justification for letting high numbers of immigrants into our country. Legal vs illegal is of little importance since our government really hasn't enforced immigration laws (and the border) for decades.

Unless we deport illegal aliens and reduce the number of relatives legal immigrants can bring here, we will lose the United States. Period.

The political/media elites are literally taking the nation away from the American people and by American people I mean, native born Americans, who trace their family ancestry in this country, back many generations.

The political elites are replacing the American people with forgeign born, who are more likely to vote liberal/democrat/statist.

Learn Spanish and get a Muslim prayer rug cuz you're gonna need both in the new "A-mair-ee-ca".

Along with my brother as good liberals, we support the president's amnesty plan. I do think though that he should provide housing for them in an acceptable environment, I don't think they would fit in well in my neigbhorhood and besides with the real estate market destroyed by the conservatives I can't afford another downgrade on the value of my home.

I live in Las Vegas. My wife called me from a local mall during "early voting" and she called me to inform me that busloads of mexican casino laborers still in their uniforms were arriving en masse and lead by their union reps to vote. They were handed cards with instructions on whom to vote for. In NV a poll worker is forbidden by law to request ID or legal status. Everyone is issued a "provisional" ballot that is, in theory, only checked after the election if challenged legally. Total BS, and an open invitation to stack the decks in the demomarxists favor.

I attended a 4th of July new citizen ceremony on a sun-filled, blue skies day.

In total 72 new Americans made it official in front of families, judges, local officials, and well-wishers.

Helping with some clean up afterwards, I could not help but notice how many of the "new Americans" left their small gift US flags just strewn on the grass, earth beneath or around their seats.

Some of the flags had been laying there awhile; they were wet with the morning dew.

I hope readers here understand; this is not insignificant. That flag is our symbol, one these new Americans and their families should cherish. Not a item to be left like rubbish.

And it is not supposed to touch ground. No adult needs to be taught this.

That flag is the symbol of freedom, greatness and, most importantly, goodness all around the world.

Candid truth: I think this complete disregard speaks volumes for the lack of qualities and values in some of the new Amercians.

We LEGALLY admit over 1 million new people via immigration into the USA every year; most begin the process toward citizenship.

Who are these people really? Why do they really come? What values do these arrivals hold dear? And is this in our best interests?

How many new immigrants has your state had to absorb this year -- just this year? Do they really come with language skills, acumen, and skills we need? And are they really of the mindset to aid and promote the greatest nation ever?

Sorry, Oldfarte. I know how you and many others feel about illegal immigration. But there are serious issues under the Supremacy Clause of what powers are exclusively federal, and what leeway states have in enacting laws which touch upon national immigration policy. Those issues are likely to be sorted out in due time by the SCOTUS in the Arizona case. Until then, District Court Judges who obey their oath to the Constitution will have to scrutinize these attempts by the state to legislate in this area.

One of the enumerated powers, that is the reasons for being of the federal government, is to protect the States from invasion. Our situation is just that yet the federal government is being destructive of the ends for which it was created not only by refusing to perform its duty but by suing the States attempting to protect themselves in the absense of federal action.

The situation is analygous to Pancho Villa who invaded Columbus NM. Woodrow Wilson no less sent the US Army under Pershing to Mexico in order to track him down. Since the government now refuses to do its duty and opposes the States protecting themselves one might be justified in asking whether the "alter or abolish" clause is in play.

There is no "alter or abolish clause" in the Constitution. If the present administration is not to our liking, we have the Constitutional power to elect a new one; if the present Constitution isn't to our liking, we have the wisely provided for power to amend it.

We also can't call on the federal government to expand its border patrol activities, round up hundreds of thousands more illegals, multiply costly deportation proceedings ten-fold, and the demand that the federal bureaucracy be slashed and taxes not raised.

Yes indeed we can elect, unelect, and amend. We can also "alter (amend, elect) or abolish" as the right to do so is a basic right of humanity and cannot be abrogated by the government.

We can as well demand you closing list as in fact we are doing. When the government refuses its duty to protect the States from invasion and opposes States attempting to protect themselves then serious issues of Constitutional proportion arise.

Just as the SCOTUS will declare WELFARECARE illegal, so too will federal judges rule that these states have a legal right to inact their own state immigration laws to protect their repsective citizens. Consider this... the Fed is authorized and directed to defend the nation... the union of multiple states. That does not preclude any individual state from defending itself. They may run afoul of Supremecy if they attempt to defend the nation.... the union of many states. But if they, as an independant and autonomous unit within the union of many, choose to defend their singular presence and populous... could that not keep them out of running afoul of Supremacy?

OF, your post is so full of inaccuracies -- so full of it, generally -- I don't know here to begin. The administration has actually fared pretty well to date in Court challenges, and most of the rulings have been in its favor, on DOMA, on immigration and on Health Care Reform. On the latter, the Circuit courts have split 1-1 on the individual mandate issue, and the SCOTUS will of course make the final decision. I've given my analysis of the prospects there several times before, and won't repeat in detail, but to summarize: (1) Kennedy may well be the swing vote, though Scalia may surprise conservatives. He has made clear that he has a healthy respect for precedent, unlike Justice Thomas, and his opinion in the federal marijuana cases specifically affirmed his recognition of the Court's precedents on the broad reach of the Commerce Clause, even to activities themselves which ate not commerce, so long as they "affect" interstate commerce. (2) there is no legal basis for any of Obama's female appointees ("pigs" in your always elegant phraseology) to disqualify themselves. There is not a shred of evidence to support your lie that Kagan had any role "in writing the adjudicated legislation", and Sotomayor wasn't even in the administration - she was a prosecutor and then a federal judge as most people know.

The Constitution is quite clear that national immigration law is a power of the federal government only. Read the Constitution some time - you might actually learn something.

La Raza did convince Napolitano to restore the Friday immigration raids though. Might seem like a logical contradiction to us documented workers but it was a very popular government program among our illegals back in the 60’s and 70’s, here in California.

The way it worked was that Jose, on Thursday, would phone in an anonymous tip to the INS that a bunch of illegal, tax shirking wetbacks was working Farmer Johnson’s fields located within the Imperial Valley. INS would go on high alert based on this anonymous tip and send a heavy contingent of armed agents and a large school bus to Farmer Johnson’s fields the next day. With a bullhorn, the Agent In Charge would demand that all illegals drop their hoes and report to the bus. The agents would take their names and herd them on to the bus for a free trip back to Mexico.

Jose would then visit the wife for a quick tickle, play with the kids and sneak back over the border to Johnson’s farm on Sunday night. Next Thursday, Jose once again borrowed the communal dime and dropped it on his fellow illegals. The INS was constantly amazed and gratified at the patriotism of these law abiding anonymous tipsters and never did catch on.

La Raza’s only qualification was that the meals provided during these bus rides be improved; baloney sandwiches are low in nutrition and high in calories they claim. Napolitano is checking with DOJ attorneys on the legality of this reasonable suggestion and has considerable sympathy with the "No Baloney" policy.

A few years ago around the time that Hispanic rallies on Labor Day were beginning O'Reilley had on his show a couple of guys who were "Professors of Hispanic Studies" from Texas. One of the professors expounded that "we a have a right to come into the USA to smash your corporations who have been exploiting us" via NAFTA. The other guy, who has been on Fox a few times since and always calls O'Reilley "my friend" contended that "America" is not really a nation, but a mystic ideal dream, and this Shambala should be open to anyone who wanted to walk in to it--and besides "our forebears the Anazasis did not believe in borders." O'Reilley did not throw these two "amigos" off the set and off camera , but it looked like he was thinking of it.

My beloved wife is a Filipina and we have been married for 6 years. The first requirment for her K1 visa was for us to meet in person. It is virtiously impossible for Phillippine residents to visit the U.S. unless they are wealthy individuals and do not pose the threat of becoming a "public charge" (sic) Anyway off I am to the Phillippines... oh and BTW we conversed via phone, email, and IM 2 years before we actually met in person. She is now a U.S. citizen and I am proud as hell of her... The LEGAL immigration process is made difficult for a reason. And as far as im concerned it should be made MORE difficult... nobody deserves a pass.
