Turnabout in Wisconsin

The gloating left tastes stunning, bitter defeat.

Wow! That’s really all I can say as I read the news that a County Clerk in Wisconsin failed to save on her computer, and thus failed to report, 14,315 votes cast in the heavily Republican city of Brookfield.

Those new votes, combined with “typing errors” in two other parts of the County appear to add a net 7,582 to Prosser over Kloppenburg, giving the incumbent non-leftist justice a lead of about 7,378 votes before other vote total adjustments from around the state. With a total of votes cast at about 1.494 million, the current margin of Prosser’s lead is now less than 100 votes short of what would be needed to force Kloppenburg to have to pay for a recount, an effort that would cost at least a million dollars and would be, in my view, as good a use of union dues money as anything; after all, it would keep them from being able to spend that money in another election.

If any more errors are found prior to a recount process which add to Prosser’s lead, one could see a situation where there is no longer a free, automatic recount, though if that were going to happen you’d probably expect it to have happened already. So far, the reported changes in vote totals in other counties are small, with a net gain for Kloppenburg based on one news report of about 30 votes over seven counties, nowhere near enough for her to reclaim victory, but putting her slightly more safely inside the margin needed for a free recount.

The Kloppenburg campaign is, appropriately and not surprisingly, “filing open records requests for all relevant documentation related to the reporting of election results in Waukesha County, as well as to the discovery and reporting of the errors announced by the County.” The vice-chair of the Waukesha Democratic Party acknowledged that she and Democrat election watchers were “satisfied that (the new count) is correct.”

Although I’m rarely shocked by the arrogance of politicians, and even giving Mrs. Kloppenburg a little wiggle room for not being a seasoned politician, the arrogance of her press conference on Wednesday was annoying and disturbing, showing a remarkable self-centeredness for someone angling to be a Supreme Court Justice.

The first question to her during that conference: “How do you feel comfortable declaring victory when the margin is so thin? Certainly Justice Prosser’s supporters think they may be able to pull out a victory in a recount process.” Kloppenburg mostly dodged the question, offering some pablum about having run a “respectful” campaign, adding “and we did win and we’re confident that the margin will hold.”

The questioner persisted: “Many observers say that with a vote count that’s this close, that could be one adding error in one county that’s making up the difference. Why do you feel that vote count is so reliable at this point in time?” (This reporter certainly gets the Carnac award for the month…) Kloppenburg’s response: “You know, the number showed that we won and we are gratified to have that victory in hand.”

Later, Kloppenburg said she was “confident that the (Government Accountability Board) will certify the numbers that we all have in front of us now” and that “we are enjoying our victory.”

Another question from a reporter who was also gunning for the Carnac award: “What would happen if during the canvassing certification that the vote flips around and Justice Prosser wins? Would you seek to challenge that?” Kloppenburg: “I won’t speculate. We’ve won right now and we’re pleased with our victory.”

In typical leftist fashion, a commenter on the Democratic Underground (with agreement from others), never fearful of the most intense hypocrisy, suggested, “In a civilized world we could expect Prosser to concede” even if the original count showed him “beaten by one vote.” Can anyone say Bush v. Gore?

I don’t like anything that makes American elections look “dodgy,” as my Australian wife might say, but despite the expected grousing on the left there is no reason to think that this was anything other than simple human error (leaving out the totals for an entire city is much less likely to be an attempt at fraud than some huge change in a city’s original count would be).

Still, one can’t help but sit back and enjoy — at least for a few minutes because obviously this is a rather fluid situation — an election where the last votes aren’t from Democrat strongholds, aren’t likely to be votes by the dead, the illegal, the late-arriving absentees, and the incarcerated — each group a remarkably reliable Democrat voting bloc, such as those who gave the U.S. Senate Race to Al Franken in 2008.

Although this is just a statewide judicial race, the implications are substantial, perhaps made all the more substantial by the apparent change in victors. If Kloppenburg had won (or if she does end up winning), it could be highly motivating for unions and other leftist organizations; they would come to believe that with enough advertising spending, they can convince taxpayers that, as Ann Coulter aptly put it, “People who are already suffering have to suffer more so that those who are doing pretty well don’t have to suffer at all.”

A Kloppenburg victory would likely spur the unions’ fund-raising gains and generally raise their level of political optimism just at a time when the Tea Party and other supporters of liberty and capitalism feel that the left is finally on the ropes in America (at least until the next time that the public forgets just how bad Progressivism is for our economic health). A Kloppenburg defeat, especially after the left poured a few million dollars into the race early, propelling Kloppenburg from being at least 30% behind in the polls to being in a dead heat even in internal GOP polls, according to National Review, should take the wind out of its sails. The gut-punch should be that much more intense for the unions after believing they won.

One has to wonder, after blowing millions in union dues money on this race, and after perhaps $10 million incinerated in a failed attempt to beat Arkansas Senator Blanche Lincoln in a primary challenge after Lincoln came out against “card check,” when the average union man or woman will revolt, even a little bit, against their money being wasted like this. Still, at the level of the union bosses this is an existential battle for their power and they won’t give up until the last of their members has been sacrificed on the altars of “social justice” and “soaking the rich.” Too bad it’s really the rank and file being soaked.

Public sector unions are nothing but massive money-laudering operations for the Democrats party. Think about it. Democrats give power to unions. Then unions use that power to collect mandatory dues from all public employees, who are paid with tax dollars. Overwhelmingly, those union dues are then donated to Democrats. So if you cut out the middle-man, the whole thing is just a way for Democrats to steal tax money for their own reelection campaigns. It's disgusting.

This may have been a mistake, but even if it was, Republican election officials countrywide should take note because it is brilliant strategy. By not reporting that city's vote count, it caused the Dems to underplay their fraud hand. Think about that. They always do just enough to steal an election overnight. Thinking the target was set, they magically came up with the votes to win by a nose (after Dem precincts had all already reported, curiously) like they always do. And then the hammer drops and the fraud would be too obvious now to come up with 7K votes. Perfect strategy. Just beautiful, in fact.

We had the same thing happen in Wa state. Except the win went to a Rep. The dem's counted over & over and the rep still won. Then all of a sudden a small bag of votes were found in a corner and guess what. The dem won by just over 100 votes.

Anyone in that Wisconsin county without a union sticker or union sign in his yard had best load the guns and be prepared for serious civil unrest, if not full-scale war.
Whether strategy or happenstance I do love the Republicans' position here; it will be hard for the Demons to overcome this "legally," but that's never stopped them from trying. As noted above, I expect Compton/Rodney King-style rioting fomented and funded by union thieves, against anyone perceived as not supporting them. After a few days, they'll find a few thousand more votes, maybe threaten, kill or injure a few of the folks in charge of the recounts (or their families), and we all know the outcome from there on. This is a long way from over, unfortunately.

Could this have been a miscalculation on the part of the County Clerk? Had Kloppenburg's "victory" been by several thousand would the clerk have come forward? The narrow 204 difference virtually guaranteed a recount where the "missing" city would have been uncovered. How can an entire city's votes be "misplaced" anyway? The revelation of how easily this election was altered is truly frightening, even if Prosser wins.

Just something to make you say, "Hmm." If the chain of custody is every broken on evidence in a criminal trial, it gets thrown out because of potential tampering. The real irony is that the tables have been reversed honestly. The margin of victory was not manufactured, it were real. The democrats applied all the influence they could muster, out of state donations, Union thuggery, and all for not. The rank and file are not being "soaked" -- they are being paid with tax dollars and have tax dollars "taken away". That is like saying you won the lottery but taxes stole half of the winnings. The unions will replenish that cash and come back for another fight -- a recall election or what have you.

Maybe a Kloppenburg victory would have had an upside: if a judge rules that a duly elected legislature cannot rescind its own laws, or that collective bargaining is a constitutional right (even though created by an act of legislation), then a case for impeachment vis-a-vis incompetence or malfeasance could be made by the executive. I would rather see judges dismissed than lose elections. This way it is the rule of law -- not 7500 votes out of 1.5 million -- that prevails. We simply cannot survive as a republic if half the voters cast a ballot for a judge who has the specific intention of unconstitutionally overturning legislation.

When the Democrats hijacked the school board election that ruined a once prosperous midwestern city, they simply voted all uncast ballots in one section of town after the polls closed. After fraud was claimed, the hand picked election commission advisors, (all leftist academics), filed a bogus report and the new all black school board handed the public schools over to the AFT. When a lawyer representing the old board finally got his hands on the log books from that election, he discovered thousands of signatures in those registration logs had the same hand writing. And these things will happen again and again until enough honest Americans risk all they have to bring these amoral despots to book at the point of a 12 gauge auto before rolling cameras. Conservatives will keep on losing until there is public revelation and halt to Democrat cheating.

It needs to be emphasized that the 'report' by the County Clerk that omitted the votes cast in Brookfield was nothing more than an informal report given to the media. The official count and report process is what is now going on. On the official count - reviewed by the Democratic and Republican official in each county - Prosser seems to have the clear lead.

In Ohio, the poll workers in each precinct are 50% Republicans and 50% Democrats, so the watchers are watching each other. Also, if a County Board of Elections head is a Democrat, the deputy head is a Republican, and vice versa. The system is not perfect, but it is a whole lot better than what Illinois and Wisconsin have.

First we need to eliminate computer touch screen ballots and return to paper ballots.

And it is time for the GOP and the Independents to bring up legislation that every voters thumb print must be attached to all paper ballots.

All paper ballots should have a serial number and all serial numbers for blank ballots must be cut off the ballot at the close of the polls. Blank ballots should be further spoiled with a sharpie marker. A trio of party poll watcher (one GOP, one Democrat, one Independent) would each initial the spoiled ballots with the sharpie marker--further voiding it.

Then the ballots are removed from the voting place by a government poll worker (and they will be accompanied by this same trio of party poll watchers) to the central counting center. No counting of any ballots until all ballots from every precinct are inside the building. Once the first count has been made ALL outstanding are voided.

This is unbelievable. As a nation we appear to be unable to function and perform basic tasks that have been required of officials in the past, and which have been performed properly, absent a few places like Chicago and Louisiana.
Every election, especially since 2000, seems to be rife with voting calculation delays, improper voting and miscounted or missing ballots.
How is it that as a nation we are failing in these basic responsibilities?
In addition, state legislatures, usually controlled by Ds, have allowed for voter fraud, especially with same day voter registration.
This one worked out for us, but the future does not look good, especially with 2012 on the horizon and the Ds and the unions all in for Obozo.
We damn well had better get a handle on this; we need to insist on rational voter laws that do not play into the Ds desire to steal elections. In addition, we need to step up, volunteer at voter precincts to help stop the fraud that the Ds need in order to win elections.

For those who haven't read the story, or other accounts, let me explain it AGAIN:

1. Voters vote - this is where real fraud comes in - felons, illegals, non-residents, dead, etc -- without Voter ID
2. Polls close and ballots (incl. absentee) are counted in the precincts
3. Results are sent to the county board along with the ballots
4. County boards report to Associated Press and others their "UNOFFICIAL" tallies (Note: Milwaukee and Sauk were the majority of the late reporting precincts - the Dem strategy to "see how many votes we need to find to win")
5. Vote must be verified by state canvassing org
6. During canvass checking of the totals in Waukesha, the administrator finds she reported ZERO VOTES for Brookfield to the UNOFFICIAL tally
7. They add the totals for Brookfield

That's it -- no "found votes" -- they were there, missing from the unofficial tally, and the ballots ARE STILL THERE. If there's a recount, they'll be there to be counted.

There were no Frankenvotes, no boxes "found" etc.

To echo another commenter, if this was a strategy to flush out Dem late phony votes, it was brilliant -- the Brookfield ballots are there, they do exist, but not reporting the tally accidently (or purposely) "set the bar" for Dems to get Klop over ... which they did ... only to find they were Charlie Brown and fixing the accidental (or otherwise) clerk's error was LUCY PULLING AWAY THE FOOTBALL....

To summarize, leaving Brookfield's votes out was:
1. Intentional - BRAVO, CLERK! Dems late reporting districts put Klop up by 204 ... Brookfield crushed their returns with real, tangible ballots
2. Accidental - BRAVO, GOD! Great plan.

There was a analysis of the Supreme Court election results in the Senate districts of those Senators facing recall. Prosser won in 7/8 GOP District with 55% or more and in the 8th it was 50/50. Kloppenburg won in only 5/8 Dem districts facing recall. So it is very possible the Dems could lose 3 and gain 1 in the recall.

I don't know if this was human error or pure genius. After all it was clear Dems were going to wait and see what the totals were so they knew how many votes to manufacture. As some of you know, I live in in Wisconsin.

After going to the polls and seeing people whom I knew had not moved to my little town recently claiming they had moved to Wisconsin in the past 10 days and were now voting, I was almost positive that the Union backed Democrats were going to pull out a victory that otherwise would not have happened.

So it was with a heavy heart that we heard the slim margin by which mummy face Kloppenberg had gone up in the voting results. I figured that the Democrats had pulled another Franken which our brethren to the west had endured.

Not so! Waukesha County brought the Wisconsin Republican Conservatives some real hope and change!

Out of spite I tracked down some of the idiots who are trying to get anyone to sign their recall petitions against our Senator Sheila Harsdorf.

I simply pointed and laughed at them. The recall is never going to happen for either side Democrat or Republican but who am I to stop an exercise in futility?

Now all I have to do is find the despicable Union rep at our local HS here who decided to tell the members of the teachers union to call in sick and ask him how he likes what democracy is looking like now?

I am going to savor that moment.

Just so all of you know. The Waukesha Democrat election board has backed up the totals in the voting results and has certified that everything is legal.

This isn't MN where missing ballots show up in a car trunk and voting totals do not match up with the amount of people who voted.

That they are all victims of white flight (all the money for infrastructure left), the city policies were segregationist, their school systems are not very good and the industries which populated those areas are no longer relevant to the US. Additionally they are all large cities in the North with Universities.

The point you make is that coincidence is not correlation and you suggest other reasons for the causality in Black Saint's list. That's fine as far as it goes, but to destroy his argument you really need to find a counter-example. Is there a strong Democrat and unionized city which doesn't show above normal poverty rates or are there Republican strongholds in right-to-work areas which do? One would still need to compensate for differences in the average poverty rates in urban, sub-urban and rural areas, if any.

I'm not saying there aren't examples, but none come to mind. It may be helpful to note that poverty is still most prevalent in Appalachia, the rural deep south, the "valley" of Texas, New Mexico and central California. It correlates very nicely with the red/blue voting maps with the notable exception of the northeast which is blue, but has a fairly low overall poverty rate.

I also suggest that your reasons may have their causation in the very same policies. White flight occurs because the cost of doing business and living go up (New Orleans which began electing heavily democrat mayors in the 60's is a prime example). Segregation was a hallmark of the Democrats. Inner-city schools suffer from both white-flight and segregation as well as teachers unions. Picking on New Orleans, again, the oil companies all moved from their to Houston in the 60's and 70's and it wasn't for the weather. Both Houston and New Orleans have good universities.

Sadly, I find these same tendencies in my adopted home town of Houston. While Texas is a right-to-work state, the largest union in Harris county (Houston) is the teachers union and Democrats have, for the last twenty years or so, begun to dominate city politics with the attendant explosion of the city budget. We now have a city government which, despite huge tax increases over the years, is broke. It also has a poverty rate about 3 percent above the state average.

Let the unions and the democrats spend tens of millions of dollars fighting states trying to get their finances in order. it's just that much less they will have for 2012. Considering Wisconsin public employees pay 700 dollars a year in dues (1000 for teachers) and the fact there is no longer any dues checkoff, the unions could be facing a loss of revenue of up to 225 million a year. After all, if there is no collective bargaining, why would you pay a union?

Michael, The ruling by the liberal judge in the Wisconsin union case is illegal. There are at least 2 examples of SCOTUS rulings that set precedent which this judge ignores including one in 1948. But to make it simple, look at the court cases over Obama's birth certificate. No judge has ruled he has a valid BC. They have only ruled (A) That no one had been "hurt' yet or (B) that the case wasn't ripe yet. This so called judge ignored that and put her personal beliefs above the law. I suggest she be recalled.

A mandamus is Latin and means "I command" This is often used when a judge wants a lower court or a public institution to follow the law. It is not applicable for this judge to issue a mandamus because that can only be done to force someone to follow the law and to halt the violation of constitutional rights. However, the Wisconsin Supreme Court would be well within their rights to issue a mandamus on this so called judge.

Michael, A writ of mandamus is a legal remedy calling for the court, as in the Wisconsin case, to overcome an election result.
A mandamus, as black letter law in all 50 states have opined, is a drastic remedy which is only to be ordered by the courts in cases of overwhelming evidence of election malfeasence.
The burden upon the moving party seeking to over come the results of an election is a very high burden to acheive.
Absent evidence of real fraud, which does not appear to be the case here, as the totals were properly calculated, but an informal count given to the AP by this particular offical, did not contain these numbers, appears to be the center of controversy.
Under normal circumstances, without political pressure, Kloppenburg has no case.

this election is all about state public unions maintaining their outrageous benefits and salaries. so union thugs, stop acting like pansies. if you feel you deserve all these benefits and a high salary, demand it directly from the tax payers. next time you are in a resturant in milwaukee, demand that the waitress write you a check for 100 bucks. this week knock on the doors of all of your neighbors and demand they make a monthly payment to you of 100-200 bucks. when you go to jiffy lube, demand the guy who changes your oil pays you a monthly sum of 100 bucks.

private sector unions collectively bargain for a share of a company's profits; a public sector union collectively bargains for a share of wisconsin workers (tax payers) paycheck.

there are a whole lot more non-union tax payers in wisconsin than there are union workers. the public sector union's time has come and is now over.
