Justice Unattainable

A lenient sentence in Cambodia.

The Communist jail warden responsible for the deaths of more than 15,000 Cambodians — part of the Khmer Rouge genocide of approximately 1.7 million people — is guilty. He might be incarcerated 19 more years; less if he behaves well, as is expected.

Appropriate punishment against Kaing Guek Eav, known as the Tuol Sleng prison’s Comrade Duch (pronounced Doik), had little chance of implementation and was never going to fit the crimes (especially since the Southeast Asian nation has no death penalty). “Even if we chop him up into two million pieces it will not bring our family members back,” said Huy Vannak, a television news director.

But even with those low expectations, the sentence was a shock to many. “It comes down to serving 11 ½ hours per life that he took, which is just not comprehensible or acceptable,” said Theary Sang, who lost both her parents during the Khmer Rouge reign of terror in the late 1970s. Few Cambodians, even today, live without the knowledge (or vivid memories) that parents, grandparents, siblings, aunts and uncles were brutally killed or starved to death during Pol Pot’s reign.

Duch received a 35-year sentence, but was credited with the 11 years he’s already served. He also was granted a five-year term reduction because the Extraordinary Chambers in the Courts of Cambodia found he was illegally detained before the creation of the war crimes tribunal. According to news reports, judges were also lenient because of contrition he expressed, for accepting responsibility for his crimes, and for cooperation he provided in cases against high-level Khmer Rouge officials that are expected to go to trial next year. They also apparently considered that Duch was part of a criminal system in which disloyalty on his part would have cost him is own life — in other words, he was “following orders.”

But accounts of Duch’s life even before Pol Pot’s rise show he was a dedicated believer in the cause and was willing to inflict unimaginable evils upon fellow countrymen for their dissent, whether real or imagined. Quoting French scholar and former Communist Party of Kampuchea (Cambodia) captive Francois Bizot, Yale University historian Ben Kiernan noted:

In his few months’ captivity, Bizot “discovered that Duch believed all Cambodians of differing viewpoints to be traitors and liars, and that he personally beat prisoners who would not tell the ‘truth,’ a matter which drove him into a rage….” A CPK defector who met Duch in either 1972 or 1973 recalled him as “ill-tempered, impatient and doctrinaire.” 

The paranoia carried over to Duch’s oversight of Tuol Sleng, also known as S-21, the secret Phnom Penh prison where guards administered extreme torture and extracted phony confessions from captives. He described repeatedly during the trial how he was responsible for death and duress, and that no one escaped or was released. Most accounts say that only seven people survived S-21. “The children were separated from their mothers and those children were smashed,” Duch said. “Because they needed the mothers to be separated so they could be interrogated, those children were smashed.”

It was worse — if you can believe it — as Nic Dunlop explained in his extraordinary book about Duch, The Lost Executioner. The convicted jailer’s expectations were well understood and obeyed, as Dunlop discovered in an interview with Ham In, who in 1972 was captive at Duch’s first prison in Amleang, called M-13:

[Ham] never saw Duch give any orders. The guards knew exactly what to do. The prison was well organized and the guards disciplined. Many of them were children of twelve or thirteen, some as young as seven. They were considered more trustworthy than their elders, unpolluted by the old ways. These children had been forcibly separated from their parents and the Organization became their only family. They became fanatical, blind leaders of the revolution, following every order to the letter, no matter how absurd or brutal.

So the stated reasons for leniency by the court were invalid. Duch was as dedicated to the Communist agrarian utopia ideal as any Khmer Rouge. He admitted culpability repeatedly in court and said he deserved severe punishment. And he called into question the sincerity of his remorse by demanding his immediate release on the last day of his trial in November.

But we’re talking about a corrupt Cambodian criminal justice system that was not enhanced by the backing and involvement of the U.N. Also, many former Khmer Rouge (including Prime Minister Hun Sen) serve in the Cambodian government presently. So far only Duch has been tried, while top Pol Pot lieutenants Khieu Samphan, Nuon Chea, Ieng Sary and Ieng Sirith — all age 78 or older — await indictments maybe at the end of this year. Only recently have they all been arrested and jailed. Even if they survive until trial, which could last years, how serious could the justice be?

Most news articles note Duch’s born-again Christianity, with some suggesting that was part of the reason for an eased sentence. In a largely Buddhist country I doubt that’s the case, but if so, that’s unfortunate. Duch may be welcomed into Heaven because he put his faith in Jesus Christ for the remission of his sins, but that should have no bearing on justice here.

What should be taken from this chapter of evil that will never be requited? Focus on those who God preserved, through miracles and their own resilience. The amazing story of Cam Youk Lim, who saved herself and five children by escaping to the United States via Vietnam and France, is a great place to start. Her son and my friend, Sophal Ear, tells the story. There are many others.

Who would ever imagine that a Democrat administration would create concentration camps and incarcerate an entire group as potential enemies like say, 110 - 120,000 Japanese Americans, including women, children and the elderly which we all know occurred during FDR's reign? The left loves to prattle on about this, conveniently omitting the fact it was Roosevelt who did this.

However, a lesser known and equally egregious crime occurred. Roosevelt also incarcerated over 11,000 German Americans during World War II as well as over 4,500 ethnic Germans who were extradited to the U.S. from Latin America. You don’t hear about this injustice though as the Germans are inconveniently white and don’t fit the left’s narrative about what a racist country this is.

Of course, this was nothing new for the Democrats. The precedent was established by Woodrow Wilson who placed restrictions on German-born male residents of the United States over the age of 14(!) during World War I. Members of my family who emigrated-legally I might add - during the German migrations of the mid-nineteenth century fell into this category. Many German Americans changed their names to avoid public stigma. My Great-grandfather changed his name from Johannes to “John.” His brother, changed his name from Eugen to “Eugene.” Nevertheless, they registered according to the Democrat President’s edict. Never mind the fact my Grandfather was a combat-wounded, decorated veteran of the Rainbow Division in World War I. Never mind the fact he spent almost 9-months in hospital recovering from his wounds.

Over 250,000 people were required to register with the Federal Government led by Democrats, to carry their registration cards at all times (how AWFUL! that Arizona wants illegals to identify themselves-guess it’s OK for legal citizens of German descent - I found the leftist media’s parroting of a faux German accent, “Vere are your papers” was their little joke during the first days of the Arizona immigration law - to be almost as childish as their love for the term “teabagger.’ Wonder how a fake Japanese or black American accent would go over?), and to report any change of address or employment. The same regulations and registration requirements were later imposed on German American females.

Over 6,300 German Americans were arrested. Thousands were interrogated and investigated. A total of 2,048 remained incarcerated for the remainder of the war.

The left has a conniption when we want to lock up our enemies but seems to think it's OK to lock up loyal Americans who they, in THEIR paranoia deem to be their enemies.

Nah! Can't happen here and, especially with the Democrats in charge. Only a Republican like Bush would lock people up without trial.

I'm not certain you are necessarily aware of this history but, your comments seem to indicate you are, indeed.

Wherever the left gains power, human rights violations such as concentration and "re-education" camps soon follow. You need only look at the Soviet Union, Nazi Germany (the Nazis were leftists - it was the National Socialist German Workers' Party), the Red Chinese, Fidelista Cuba or any other leftist hellhole to understand this.

Is it possible the Obamaviks will establish something this horrible? Well, even I think it's unlikely but, it's not impossible considering the history of the Democrat Party, which before now was not even as leftist as it is today.

Ask youself this: weren't FDR and Wilson two of our most revered Presidents? They were but, look how they treated their perceived enemies.

Is it feasible that a student of Frank Marshall Davis and Saul Alinsky could do something equally evil? Well, we hope not but it has happened before under Democrat rule.

I know, I think I know, how you feel but let me ask you how doing any of the above to this guy would accomplish anything, solve any problem or replace any life? Yup, the guy's a monster. All his buddies are monsters.

I say that the simplest thing to do would be to simply turn the guy loose. I suspect that he'd last about fifteen minutes.

What about the American Military, Intelligence and political folks that knew for a damned, air-tight fact what was going on in Cambodia and didn't say a word? How about the UN for that matter, they knew too.

By the bye, there was a guy in college that I kinda/sorta knew that escaped from Cambodia. Before he got out of Cambodia his parents and brothers and sisters were taken away by the Khmer Rouge and killed off one by one on the way to wherever it was that they were going. Apparently the men and boys were just killed. The women and girls were kept around for a while for their entertainment value.

Anyway, to make a long story shory, this guy started killing the Khmer soldiers after they had finished with his family. There was a rumor that the guy ate the heart of the first guy that he killed. I don't know, don't want to know and it's none of my business anyway. I don't think that he got to kill them all becaust the Khmer caught on and took countermeasures. Anyway, to make a long story short, the guy made it to the US, was adopted by some folks then went off to college and his only reason for living was to join the American Army, learn how to be a soldier and then go back to Cambodia and kill Cambodian Communists.

That's a hell of a way to live a life.

Briefly in response to the "what good would it do?" line of argument: it would be good because the little bastard DESERVED it, and his mutilated corpse would be a good EXAMPLE to others like him (especially, people like the Vtwin poster here, who would put us all in concentration camps if he and his buddies could--and they're laying the groundwork now, so be vigilant).
And that Cambodian friend of yours who made it out while knowing his family was being tortured and killed--good for him. He has my undying admiration. You have the luxury of saying "That's a hell of a way to live." He didn't. Would you seriously just find a guitar and sit on a corner, soul-searching and preaching against violent retribution, if your family was massacred that way? I think THAT would be a pathetic way to live.

Vtwin, please go ahead and explain to all of us the differences between the Khmer Rouge's ideology, and Obama's (or, Van Jones, or Bill Ayres, or Rev. Wright). Once you've explained that sufficiently, then maybe I'll let my guard down.
But since you can't, and won't, and you clearly think you'll be one of the guards at the camps instead of one of its first victims, I'll maintain my vigilance and do everything in my power to ensure that when Maobama's thugs come for my family, they'll lose a lot of stormtroopers in the process.

Those of us who are Christians MUST remember that God Himself is literally watching over our shoulders. He will either bless our actions…or not….and He knows our innermost heart.

It finally dawned on me this morning… “WE ARE ENGAGED IN A BATTLE OF WE FALLIBLES AGAINST EVIL”. I am defining “Evil” in precisely the way the Bible defines it. (Turning one’s back on our Creator.)
As Quin suggested in his blog Friday… Obama and crew have literally declared war on Louisiana. I added Texas and Oklahoma and Arizona to the list, but I must add all of you “God-acknowledging “ folks reading this to the list.

Folks, I no longer call myself a “CONSERVATIVE”. I don’t want to conserve what our country has become. Yeah yeah, the term has been coined …and we know what it means… to each of us …… more or less. Nevertheless, until I can come up with a better label for me, I shall just call myself an “ORIGINALIST”; in the sense of the original founding principle of our country in the Declaration of Independence “…… endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of happiness.”

And again “….. all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security. “”).

Folks, in my heart of hearts, I believe we are rapidly approaching that point of “absolute Despotism” referred to in our Original Declaration. That Declaration ushered in our REVOLUTION BEGUN IN 1776. In the Spanish language then… “Viva La Revolution!” (long live the revolution!)

As I see it, we have literally been in the midst of a “counter-revolution” for many years. The forces of evil, (defined above), are now arrayed against us…and our posterity. Think about it a moment before discarding this question: “What in the world could align our present ruling class with Islam?”

Allies of convenience?

My answer is simply this. “Our ruling class… and Islam…and the communists… have turned their back on our Creator, and for precisely the same Object; to “reduce (us) under absolute despotism.” ……AND…ultimately mass murder unless we “submit”? (The exact English term for “Islam”, interestingly enough).
So,
I think we must re-define “The War”. ….. We have all read endless yakkity yack about our “culture war.” Bull-corn!!!!!! We are at war with Evil, with a capital E.

It seems to me that we are rapidly approaching the point where each of us must decide to either “submit”….. or….. withdraw our consent to be governed by these kinds of people.

Just as there was for Hitler's Nazis, there should have been a worldwide manhunt for any living Communists who participated in the slaughter of millions of people in the USSR, China, and other countries.

When you look into the eyes of this killer-without-a-soul, you are looking into the eyes of the Communist nightmare.

I am employed by one of the world's best-know and most-respected global companies. My colleagues include Russians, Chinese, Vietnamese, Poles and others who have lived under the Red boot. To a man, or woman they will tell you living under Communism was hell.

Something to consider next time you see some leftist idiot like Oliver Stone or Michael Moore or Maxine Waters ooze over some other Commuist mass murderer like Fidel Castro or claim another murderer of millions like Mao as a "mentor" as Anita Dunn did.

I recall vividly the images of the "Killing Fields" and the impotence of the Carter Administration. It's true though, that even if they "chopped this guy into a million pieces," the evil cannot be undone. These people need to be stopped before they gain power; which we would have done except for the Democrats refusing to aid the Cambodian freedom fighters let by Lon Nol. At the forefront of this infamy was Congressman, now Senator Chris Dodd and others of his ilk.
