The sweet nothings Hillary Clinton whispered into the ears of
foreign television audiences went stateside on Friday, as America
media outlets began confirming what the secretary of state first
told an Ecuadoran news channel: the Obama administration is
planning a lawsuit against Arizona’s new immigration law.
Publicly, Obama administration lawyers will only admit that a
thorough “review” of SB 1070 is ongoing. But the toothpaste is
out of the tube. Officials in Eric Holder’s Justice Department
are quietly giving word that it is a matter of when, not if, they
will seek to subvert Arizona’s attempt to protect its people from
porous borders.
On cue, Arizona Attorney General Terry Goddard — the Democratic
gubernatorial candidate — dropped his promised “vigorous legal
defense” of the law. Goddard opposed the statute and had been
sparring with Gov. Jan Brewer, his likely Republican opponent in
the general election, about how it will be defended.
According to a recent ABC News/Washington Post poll,
Americans side with Arizona by a 58 percent to 41 percent margin.
In late May, Quinnipiac put the numbers at 51 percent to 31
percent. CBS found that 52 percent think the Arizona law is
“about right” while only 28 percent believe it “goes too far.”
Another 17 percent said it doesn’t go far enough. The breakdown
among Democrats was 46 percent “just right,” 40 percent “too
far,” and 10 percent “not far enough.”
These numbers come in spite of a very public campaign to boycott
Arizona and label the new law a tool of racists, Nazis, and
Communists. “While opinions on immigration are complex,”
Atlantic blogger Chris Good
notes cautiously, “it’s reasonable to wonder if the
administration’s decision to sue Arizona will turn out to be an
unpopular move.”
So reasonable, in fact, that the administration went all the way
to Ecuador to find a suitable launch pad for its Arizona trial
balloon — and these are people who are as adept at fencing
themselves off from public opinion as they are incompetent at
fencing off the border. Let us hope that the Justice Department’s
legal case is based on something more substantial than the
secretary of state’s disinformation.
“President Obama has spoken out against the law because he thinks
that the federal government should be determining immigration
policy,” said Mrs. Clinton. But Arizona did not create new
immigration violations out of thin air. It took what were already
federal crimes and made them state ones too, while giving local
police a reasonable opportunity to enforce them. In other words,
Arizona followed the federal government’s immigration policy.
Even the state’s enforcement role is limited. Arizona can’t
deport anyone. It can only refer the people it believes are
illegal immigrants to the Immigration and Customs Enforcement
agency. The federal government remains the ultimate arbiter of
who is in the country illegally and still sets immigration
policy.
The federal government’s bipartisan dereliction of duty on this
front is precisely what prompted Arizona to act in the first
place. Washington has failed to effectively enforce its own
immigration laws, either at the border or in the workplace. It
has allowed Arizona’s illegal population to explode from 300,000
to 560,000 in less than a decade. The feds only partially
completed a security fence, actually diverting inflows into
Arizona and making it the entry point for more than half the
country’s illegal immigrants.
When Arizonans tried to do something about it, John Morton,
Obama’s head of Immigration and Customs Enforcement (which is
under the jurisdiction of Homeland Security), said
his agency might not process suspected illegal immigrants
referred to it under SB 1070. Now, after the president made some
obligatory pro-enforcement noises in a White House meeting with
Governor Brewer, the Obama Justice Department seeks to have
liberal judges overturn the whole thing.
Arizona had already revised the law to address concerns that
Hispanic Americans might be racially profiled. It has already
passed a series of other tough enforcement measures which may
have
helped reduce its illegal population by 18 percent between
2008 and 2009, compared to 7 percent nationally. But the Obama
administration will not give the latest Arizona law a chance to
work or even show that it can be implemented fairly.
Up until now, the political class’s biggest contribution to
controlling illegal immigration has been wrecking the American
economy to the point that many illegal immigrants have decided
they are better off at home. No word on where Arizonans are
supposed to go now that the Obama administration has decided they
cannot protect themselves from a constitutionally indifferent
federal government’s manifest immigration failures.

There appears to be no legal basis to challenge the Arizona law. The wording of the statute matches federal law. And federal law does not precluding the states from enforcing a ban on illegal immigration. As such, this looks more like a political gesture than a real legal challenge.

One must consider the current example of California's "Gay Marriage" amendment to the state constitution. The amendment went through the long and difficult process required just to appear on the ballot. It won approval from the majority of Californians. Yet now, that amendment to the California Constitution is being fought in court on the basis that the amendment to the constitution is unconstitional to that constitution. One can reasonable ask "isn't that what amendments do?" Don't they often take objectionable evolutions in legal developments and rectify them according to the will of a free and self-governing people?
With liberals, the argument isn't the argument. The present legal challenge to California's amendment is a "form" of an argument which is only a means to an objective. This "form of an argument" is a principle which may never have been invoked in the past and may never be invoked again. That is because consistency is found in the objective. How they get there is OK as long as they get there.
In the case of Arizona, the real of objective is not the illegals. The real goal is more voters for the Democrat Party and the illegals are the means to that end. Rights Smights. Civil rights of the illegals? They only exist at the pleasure of the Democrats. If all the illegals suddenly began to vote mostly Republican, look for the Democrats, the progressive churches, and the "pro-immigrant" organizations to turn on a dime and demand three separate fences along the border with mines fields in between. An infantry division or two wouldn't be a bad idea either.

The Federal Gov. will not rescend the laws they have created. When have they ever done that? Rather, they will continue to add laws to the "books" and they will remain unenforced. Arizona's Governor will have to go it alone, even though she has plenty of moral support from the other states. What has my panties in a wad is the lack of Federal support for Arizona and their efforts to limit illegal immigration. If the Feds don't support Arizona then who does? Those people, brave no doubt, will have to go it alone and may very well succeed. The only way for the Feds to win their case would be if the courts are biased. Very simple way to get California to support Arizona's new law. Have Arizona create an amnesty program - for 30 days any illegal alien may turn themselves in. If they do so they will be given a voucher. The voucher will allow them to get a free bus ticket to San Francisco, plus a box lunch and $100. The voucher will let them avoid deportation until they are able to get on the bus. SF will suddenly have an influx of thousands of illegal aliens that they will have to support and deal with. Will the liberal citizens of this city continue to boycott Arizona or will economics cause them to pull their heads out?? Time will tell.

This leads me to the following questions: 1) If the courts rule in favor of the obummer dictatorship, will the Federal Law it enforces also be tossed in the trash? 2) Might this be their true objective?

But it is believable when you consider Obama’s Socialist/Marxist constituency intends to use millions of illegal immigrants to force unaffordable public services on States and U.S. Government that will financially overwhelm and cripple government infrastructures, problematically destroying the United States. American won’t die immediately, in the interim Congress to forestall an economic collapse will have to hugely raise Citizens’ taxes, ironically that will feed leftist mandates that Citizens’ share their wealth with the masses. Increasingly it appears Obama intends to force a form of Marist/socialism on Americans—even if that means destroying the U.S. economy. The longer Obama can keep the Mexican border open, millions more illegal immigrants will come to America to financially bleed U.S. Taxpayers and governments dry, politically changing the direction of America toward Socialism. If leftists succeed in spending America into bankruptcy, it is foreseeable millions of disparate Americans might accept, even welcome a hybrid form of Marxist/socialism.
Recently the Obama administration took legal steps to prevent an Arizona illegal immigration law taking affect that would criminally charge employers who knowingly hired illegal immigrants; leftists consider it collateral damage of their cause that illegal immigrants take American jobs. America’s greatest threat is not from foreign enemies, but the Marxists malignancy that is spreading—in U.S. Government. Consider what Obama has already accomplished. During the worst recession since the Great Depression Obama’s has forced (unaffordable) health insurance, new taxes and regulatory costs on U.S. Citizens and businesses that will inhibit investment and hiring of new employees for years. Obama’s forced heath insurance costs on Americans that will disqualify millions of self employed middle class home buyers qualifying for home mortgages; qualified home buyers are desperately needed in this recession to support and stabilize home values that secure trillions in bank held mortgages so banks don’t fail. I don't really understand the furor over Arizona's immigration policy. Don't they have the right to enforce whatever laws regarding immigration, however, they want? The 14th amendment seems to make policy regarding citizenship pretty clear, and Arizona doesn't seem to be violating anyone's due process in their enforcement of this amendment.
I guess I just don't see anything Constitutionally wrong with this law. Can someone help me out here.

The 14th Amendment does talk about citizens, but it also mentions all persons, without regard to citizenship.
"nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." - This is the crux of the issue ... is the law being applied equally to all persons in AZ? Does it apply equally to all blond, blue-eyed types, as well as brown skinned, young, old, male/female? It's supposed to, sure - but, just exactly how do you prove that, when the application of the law can be very subjective?
And, in addition, one provision of the law allows for an individual to report someone as illegal and if the authorities don't respond positively, they can be sued for non-action. That does smack of the Gestapo tactics of neighbors reporting neighbors, doesn't it?
The Supreme Court has ruled that the Congressional power to regulate naturalization, in Article 1, Section 8, includes the power to regulate immigration (see, for example, Hampton v. Mow Sun Wong, 426 U.S. 88 [1976]). It would not make sense to allow Congress to pass laws to determine how an immigrant becomes a naturalized resident if the Congress cannot determine how that immigrant can come into the country in the first place.
There is also an argument that immigration is an implied power of any sovereign nation, and as such, the federal government has the power to regulate immigration because the United States is a sovereign nation. While it is true that the United States is a sovereign nation, and it may be true that all sovereign nations have some powers inherent in that status, it is not necessary to determine if immigration is such a power that does not even require constitutional mention, because the Naturalization Clause handles the power.
In other words, mmigration law is the sole responsibility of the Federal Government, according to the Constitution. So what was the purpose of the law, besides political? It won't pass Constitutional scrutiny and strict constructionist theory.

immigration law defines who and under what circumstances someone may enter this country. The border patrol's duty is to enforce those laws. After someone circumvents the law and the border patrol they become common criminals.
Arizona has every constitutional right to arrest criminals in their jurisdiction.
They then turn them over to ICE to again adjudicate the immigration statues.
Where in the constitution does it say a state may not arrest criminals.
I would suggest, before deciding constitutional law, it might behove you to read it.

Most Americans have no idea what is taking place in Arizona. Americans living in this state, within 60 to 80 miles of the Arizona/Mexican border, have for years now been terrorized and have pleaded for help to stop the daily invasion of illegal border crossers. The people living in the southern part of this American state are living in a war zone. Most of them live in rural areas, small ranches and isolated homes. The illegal's and drug smugglers are using these areas as highways.
One rancher testifed at a senate hearing that 300 to 1,200 people A DAY come across his ranch, vandalizing his property, stealing his vehicles, cutting his fences and destroying the habitat with their trails and layups. In the last two months he has found 17 dead bodies and two Koran bibles. However, as outrageous as those problems are they pale in comparison with the murders by these illegal's. Rancher Rob Krantz, murdered by the drug cartels, Border Patrol agents shot and wounded and shot and killed. Another rancher testified that drugs are brought across his ranch in a military operation. A point man with an AK-47 type weapon goes in front. 1/2 mile back are more guards fully armed with automatic weapons. 1/2 mile behind them are the drug carriers behind them more guards with automatic weapons. These people are violent and they will kill anyone who gets in their way.
It unbelievable that our Government continues to let these conditions exist. Now the President promises to send 1,200 National Guard troopers to the border. What a great guy. That works out to about 1 trooper every mile and a half. Yeah right that one really works! What about the Border Patrol? The Border Patrol is not on this border. They have set up 60 miles away with check points that do nothing to stop the invasion. The Border Patrol is undermanned and undergunned. They run around trying to catch the illegal's, if they do, all that happens most of the time is that the illegal's are taken back across the border so they can try again.
Federal prisons have over 35% illegal's and 20% of Arizona's prisons are filled with illegal's. In the last few years 80% of our law enforcement officers killed or wounded have been by illegal's.
The majority of people coming over recently are people we should be worried about. The ranchers
testified the people they now seeing are not the same as people in the past, those looking for work. We know the coyotes will bring over anyone who has the money to pay. Can anyone say terrorist? Count on it, these bastards have already brought terrorists the United States. The lame stream media has distorted what SB 1070 will do. SB 1070 is built on Federal law and in fact isn't even as strict as the Federal law. It will give law enforcement the ability, when there is probable cause, to determine if a person is here legally. Federal law is very clear. If you are in this country on a VISA, you must have your papers on you at all times. In Arizona all you need to show you are legal citizen is a drivers license, MVD identification card, Native American Card or a military I.D. card. Anyone needs these documents to vote, get a hunting or fishing license etc. So nothing has been added to the Federal law. No one is going to be stopped walking down the street or going with the kids to get an ice cream (take note Mr. President). The Progressives who are currently in power in D.C. are angry because we dare to try to do something to protect our citizens. Our current President and his Administration lie like hell and tell us they want to protect the border and have a reformed immigration policy. They don't. What they want is open borders and ammnesty They are pimping for the Hispanic vote, which they believe they will
get with that policy. In the mean time Americans are being terrorized, the border is wide open, our schools and hospitals are spending more money than they can afford, Arizona like most states and our Country is broke, our prisons are full of illegal's and all this bunch of incompetent boobs in D.C. can think to do is sue Arizona for trying to protect itself. I have a job in a tier I automotive plastic injection molding plant. In order to be hired in this plant I had to show two of three pieces of identification proving that I am an American citizen. I had to show a birth certificate, a drivers licence or a passport, two of the three. I had to furnish to the employer two of three of these formal identification documents. Two, count 'em out of three.
I am told that employers are required by federal law to verify the citizenship status of a potential employee before hiring that employee. Now, if that's the case then how is it that an illegal can get a job anywhere? If that's the case then when the Immigration folks show up at a business and bust their hourly labor for being illegal then how is it that the owners and managers of the businesses aren't hauled off to jail?

Now, if according to the law I have to prove my citizenship status before a company can legally hire me then how the hell is it that the Commander-In-Chief, the President of the United States of America doesn't have to prove his citizenship? How can that be?

Six yeras ago here in Nevada Harry Reid got elected by a majority of 560 votes (against Ensign). These votes were provided by the Culinary Union whose members are by large majority illegal aliens from Mexico; the union card is accepted by the casinos which "rely" on the union to verify the status of its members. The union was so happy with its "success" that it plastered big signs all over Las Vegas to that effect.
Why hasn't the ICE and/or FBI ever checked the union books? Speaking Spanish (I lived and worked 6 years in Mexico and Spain) I heard one worker instructing a new arrival how to become legal: "Just go the union building over there and they will give you papers to work here". This happened in the back of the Stratosphere Casino during a break - and one could see the Culinary Union headquarters building some 80 yards away.

Being a liberal means there are no rules or laws. It means they can do what they want whenever they want. The gov. will just find a liberal judge that will provide cover and then lie their way to pass an amnesty program. With RINO's like, McCain, Snowe, Collins, Graham, Brown, liberals will get what they want, they always do. Otherwise they'll astroturf with union protests, take over gov. buildings, march the streets blocking traffic and commerce and show up at the homes of the opposition to harass and intimidate these people. But no it's the tea party and those old gray haired grannies that are so violent, mean and dangerous.

Seriously, though, do the courts have the authority to overturn law that does not violate the Constitution? Everyone assumes that they do. But do they? My contention is that they do not. They are overstepping their authority when they try. It is the legislature that writes law, not the judiciary.
My point is that the courts can go ahead and make all the noise they want, but they cannot stop any state from writing/creating law. If we listened to the courts back in 1857 (Dred Scott), then slavery would still be legal. In that decision the U.S. Supreme Court upheld slavery. President Lincoln and Congress went ahead and ignored their ruling. If the Supreme Court is the "supreme law of the land" as we are taught, then why do we no longer have slavery? It is because the courts are not law, and do not rule us. No one can stop Arizona from writing and passing any law as long as no-one's civil liberties are being denied--and no, illegal immigrants do not have a claim on our civil liberties.

I believe that obama wants to destroy the united states and make it all a minority country until the time they can kill,breed the white race into history.I say to the people of the great state of ARIZONA,and all american citizens to work together and patrol the borders. If you see illegals make them happy to run back to mexico,and if they have weapons or drugs ,kill them where they stand,that will stop alot of them from comming here.Then take the mexican people living in our cities ,legal or illegal and if they are cought with weapons or drugs,send them home on the next bus and let them know if they are caught here again,they will be old when they get out of prison.Last but not least,BP do what you feel is the best thing to do when you are threatened by an illegal,deadly force if you have to,dont wait until they wound or kill a person,dont worry about odumma or holder,we the people will stand behind you all the way!Arizona will protect you. Deemers are consistent in actions and thought, you can count on them to do the wrong thing and most of the time it is intentional because it is going to benefit them. They are the Jackass party and here is another case where this particualr obstinance is associated with ignorance, Barry s bound and determined to again "do the wrong thing" to benefit the Deemers and it is almost certain that the state of AZ will deal him a well deserved slap in the head when the court ruling is passed down.
Consistency of ignorgant planning and circumstance, the oil spill, the lifting of a unwise moratorium, the C&T CO2 joke, the infamous backroom unread health care scam, which more states are going to got to court on soon or go broke trying to accomodate this stupidity, TARP Theft. You know that after the houses are reorganized that investigations to find out who this money went to and who recieved it are going to blossom like flowers on a spring plum tree.
