Obama’s Supreme Problem

One detail was missing from the President’s list of qualifications for his nominee to replace John Paul Stevens.

One detail was missing from President Obama’s list of qualifications for his nominee to replace John Paul Stevens on the Supreme Court: Any mention of the Constitution.

He just doesn’t get it.

At a time when Americans are furious over Obama’s headlong plunge into socialism, when his Democrat party is losing elections and hemorrhaging incumbents because voters reject their big-government “remaking America” agenda, the chameleon forgot to adapt.

The master wordsmith — who knows how to say what people want to hear — blew it.

He didn’t state the main qualification for any person who serves in government, the absence of which has lit a brushfire of discontent, fidelity to the Constitution.

He and his allies haven’t taken that first step to recovery — acknowledging their problem. It’s their utter disregard for the Constitution that is causing this big mess. The concept of a limited government, restrained in what it can and should do, is foreign to them, while for most Americans it’s in our DNA. This is what puts Obama at odds with so many Americans.

President Obama said his Supreme Court nominee will be someone who knows “that in a democracy, powerful interests must not be allowed to drown out the voices of ordinary citizens.”

Newsflash for the president! The most “powerful interest” in America today that is drowning out citizens’ voices is…. the government!

Citizens are trying all kinds of ways to be heard by their congressmen — phone calls, e-mails, rallies in districts, rallies in D.C., voting against the party in power.

In Obama’s mind, “ordinary citizens” are paid ACORN protesters but not unpaid Tea Partiers. His version of “Let them eat cake” is “they can’t get a job and their doctor quit, but they’ll have insurance.”

Anger at the cap-and-trade bill drove huge turnouts to town hall meetings. How did congressmen respond? They held town halls in gated communities or avoided meetings altogether. They denigrated their constituents, calling them “brown shirts” or “Astroturf.”

Remember the kerfuffle over James O’Keefe getting arrested in Sen. Mary Landrieu’s office? Overlooked in the story is why he was there. He was trying to find out why her constituents’ phone calls weren’t being answered. Was there a problem with the phone system, or was her staff ignoring the calls?

The best picture that captures this arrogance is Nancy Pelosi pounding an oversized gavel in her hand while marching with congressmen to vote for the health care bill — in defiance of the thousands of protesters surrounding the Capitol begging “kill the bill.”

One thing we can all agree on is that the Constitution is the foundation for our country, the main unifying element, what distinguishes us as America. It provides defined roles for the government, based on the profound recognition of the sinful tendency of mankind to abuse power.

So why do liberal politicians have a problem when people bring it up?

And yet at the same time he openly ( the pretender) thinks somehow it is more importent to have an unqualified person sit on the highest court of this land who has feelings, please give me a fricken break, if this does not prove beyond any shadow of anyone's doubt he's an imposter, I don't quite frankly know what the hell would change an ignorant mind.

I know you just had your lobotomy recently but those of us who do have a whole brain are aware that this President took an oath to preserve, protect and defend the Constitution of the United States. Now if said President actually said before he got elected that he thinks the Constitution is obsolete, and then after he takes office behaves as a complete dictator, not a paid public servant, which he is, excuse us if we have a problem with that and you don't.

Purpleguy....Read your constitution, no president is "put in place to rule over us" He works for us, as does all elected officials. Obama is not legally president of our country. Disproving all the accusations about birth could be done quite easily, the way all other candidates have done. Birth Certificate, school records, all should be a matter of public record when one runs for president. If he has nothing to hide , why does he NOT provide the proof? The main thing to remember , is that our constitution says all elected officials work for us. We are supposed to be their boss, not the other way around.
I am a life long democrat who DID NOT vote for Obama , as I believe that he is not qualified in any way for the office and he has done nothing to change my opinion. Plus the fact that he is a muslim which has become very obvious. If you doubt that.....check out the speech he made in Egypt in 2009. If you do not have a copy of the constitution, I have found a web site that does have one. patriotnews1.com. They have the constitution and all the amendments ...they also have all the bills that are pending in the house and in the senate. Some of those will shock you.

One has to suspect that too many members of Congress believe all the protest and anger will go away at some point. They may even be dismissive of predictions of political blood-letting to come. Lost in the Stevens excitement are the nominees for Appellate and District court judges. This does almost as much damage inasmuch as SCOTUS cannot hear every appeal.

Not only does Obama get two SCOTUS appointments in about a year, but he may have a third (Ginsberg). This is a unprecedented opportunity for the Leftists to get a strangle hold on this country for at least another generation. I wonder how many voters respected the repercussions of what they were doing back in '08?

Obama is laughing at us; here we are saying "...we must follow the Constitution!"As long as there is a large Democrat majority, Obama is, my guess, going to shoot for the moon in Steven's replacement. He wasn't much impressed with the health care protests, why would he change now?

Hopefully, we can use this as teachable moment -- should this country survive -- when the next generation of Americans decide to 'teach Republicans a lesson' by voting in Democrat majorities.

Great points, George. We oftentimes get so focused on the SCOTUS that we forget the damage done by the lower courts. Many cases don't even make it to the Supremes, so lower courts probably have as much or more influence than the Supreme Court does. I also agree with your analysis about Obama. He seems to relish in picking fights, creating conflict. If it's not pathological, it's very close to it.

Not only that, MTB, but what I found infuriating was that the Democrat minority from 2001 to 2006 managed to stop Bush's appointments to the lower courts, including the critical 4th Circuit. Estrada and Brown come to mind. From a position of strength, Republicans caved in when the Gang of 14 struck a deal with the minority. Watch what happens if Republicans attempt to filibuster any of Obama's nominees. What a surprise McCain and Graham will discover when the dog they stroked turns around and bites them.

Obama could not very well say he was looking for a candidate with fidelity to the Living and Breathing Constitution, now could he?
Obama has told us what he thinks of the Constitution; it is outdated and does not speak to what the government CAN do for the people, as opposed to what is actually contained in the document, to wit, what the government CANNOT do to the people.
This situation is intolerable to Obama and the radical Leftists legal "scholars" who believe the Constitution, and the Court, should be devises for implimentation of Leftist "social justice".

What goes around comes around. It will only take a few more decades until the liberal project is complete. The Constitution will be seen by the vast majority of Americans as not a wall protecting Americans from tyranny, but as just another spoil system used by politicians. By then, the Constitution will have been deconstructed to mean almost anything to anyone. Right will be wrong, and wrong will be right. The niceties such as the Bill of Rights, and Due Process will have gone the way of the 8-track. And all of those factions and "minorities" who aided and abbetted the destruction of the Constitution will suddenly find themselves powerless. For most of these groups are in fact tiny minorities. Who knows what will become of gays, or religious minorities. For by then, America will not be a nation of laws. And all of those people who helped destroy the Constitution will suddenly see the legal giants who created the "Living Constitution" (Warren, Blackmon, O'Douglas, Brennen, Souter, Ginsberg, and Stevens) not as heroes but the petty tyrants they were. There are a few truisms in life; two of them are: Be careful for what you wish for, and What goes around comes around.

I'm sure the author knows the answer - as does most of the readership - but I'll say it anyway: Because, if they did, it would not permit them to indulge their overwhelming lust for social engineering. They would have to persuade others to go along with them, not use the coercive power of the government to make others go along.

The desire to control the choices of others - for whatever they deem good - is the rock-bottom motive of every so-called liberal (and, let it be admitted honestly, some so-called conservatives).

If you had listened to the Congressman when he said it, although it was a poor choice of words, he was answering an attack by a Republican who was stating the "rules" of the Healthcare voting ... but Alcee Hastings correctly said as a member of the House "Rules Committee" that they make up the rules - they do and they did. Period, end of story. Had he said "they make the rules" the issue would not appear. Our situation is much more serious: Abu Hussein from Kenya means business. He has done away with Israel; he is condoning nuclear arms for Iran and North Korea (well, one is muslim thugocracy and the other is a communist heaven); he has now over 50% of voters on the dole, and that ration will go up to 60% with the coming amnesty of illegal aliens; he is naming dedicated communists to the federal benches; and he is continuing his program of nationalizations (banks, indurance companies, mortgage companies, car companies, oil & gas companies, coal mines, electricity companies...). What we have is not a socialist but a dedicated marxist-leninist in this Community Organizer-in-Chief. His treatment of Netanyahu is an example of how a Muslim would treat him.

President Obama said his Supreme Court nominee will be someone who knows "that in a democracy, powerful interests must not be allowed to drown out the voices of ordinary citizens."

I thought the government in America was a republic, not a democracy. How BHO transformed this too?

Losing elections? Really? The Dems lost a Senator and a couple of governors, but ALL 6 House special elections this term were won by the Democrats. That's right - all 6. Special elections are usually good harbingers of the main event. Taking back the House in November isn't the slam dunk so many of us think it is. We might actually have better prospects taking the Senate.

I am not an Obama fan and I favor a moderate conservative for the court. I do take issue with your claim that ruling that all people have an equal right to marriage is somehow imposing homosexuality on us. When in reality it is the extreme right, the intolerant social conservatives who want to impose their religious views on everyone. This is a center right country, and the center part wants no part of social conservatism and Republicans embracing that agenda once again is probably the only way they can screw this up and not win back the congress.

Everyone - everyone - has exactly the same right: to marry anyone of the opposite sex who'll put up with them.

Well, Obama couldn't care less about the Constitution. We all know that. I just wish somebody, anybody, would bring this administration up on charges, including Congress!! Let's have a trial, and see how it all comes out in the end. Then, the American people will have a chance to get this country on the right track.
