Pennsylvania GOP Sues ACORN and Rendell Appointee

Lawsuit alleges fraud and sets up charges of stolen election.

The Pennsylvania Republican Party filed a lawsuit on Friday against Secretary of the Commonwealth Pedro Cortes and the Association of Community Organizations for Reform Now (ACORN) and its subsidiaries.

The announcement was made at a press conference in the State Capitol by Pennsylvania Republican State Chairman Robert Gleason. “With the election being only a couple of weeks away and with more and more incidents of voter fraud coming to light, we don’t believe that we can trust the results of this election,” Gleason said.

It alleges fraud in the counties of Philadelphia, Allegheny (Pittsburgh), Delaware (suburban Philadelphia), and Dauphin (in Central Pennsylvania and site of the state capital of Harrisburg).

Both ACORN representatives and a representative of Pennsylvania’s Democratic Governor, Obama supporter Edward G. Rendell, were present at the press conference and opposed the move in separate presentations of their own.

“ACORN’s fraudulent activities threaten to dilute the votes of millions of Pennsylvania voters by allowing unqualified individuals to cast ballots and again undermine the voters’ confidence in the electoral process in the upcoming election,” added retired Pennsylvania Supreme Court Justice Sandra Newman. “The Republican Party of Pennsylvania is seeking to obtain relief necessary to ensure that the 2008 General Election is fair, open and honest manner in order to preserve the ability of qualified Pennsylvanians to cast votes.”

The lawsuit was filed in Pennsylvania’s Commonwealth Court. The suit charges Cortes, a Rendell appointee, with not giving county officials “timely” data to search the state’s computer system to look for fraudulent voter registrations. It seeks an order directing the Secretary of the Commonwealth to ensure that the Statewide Uniform Registry of Elector (SURE) System “provides, in a timely and efficient manner all Election Officials data about registrants ineligible to vote, as required by state and federal law.” It also demands that Cortes “ensure that all Election Officials require identification from all first-time registrants and also demands that the Secretary provide a significantly larger amount of provisional ballots at each polling place so that voters whose voter registration has not been timely processed by Election Officials on or before the day of the 2008 General Election can vote provisionally.”

The state GOP is also asking that ACORN and its subsidiaries be blocked “from all attempts to encourage voters who have submitted false or duplicate registration forms from voting or attempting to vote in the 2008 General Election,” and that the court “directs the ACORN Defendants to provide to the Plaintiffs, the Secretary and the Election Officials copies of any and all lists identifying the names of individuals for whom the ACORN Defendants submitted voter registration forms, and directs the ACORN Defendants to fund public service announcements to educate all first time voters about the requirements to present identification in accordance with state and federal law, whether voting in person or via absentee ballot.”

ACORN officials held their own news conference to accuse the GOP of “voter suppression” targeting minorities in an effort to deny them the vote. It claimed it has registered 144,000 new voters in Pennsylvania with between 60 to 70 percent being identified as “people of color.

Rendell spokesman Chuck Ardo also spoke to reporters, accusing Gleason and the other participants in the suit of being “Republican hatchet men” trying to steer attention from a looming defeat. He described the GOP suit as whining.

Pennsylvania is considered a “battleground” state in the presidential election. Both candidates and their running mates have appeared repeatedly in the state and commercials are flooding the state’s five media markets from Philadelphia in the Southeast to Pittsburgh and Erie in the West.

The ACORN allegation of “voter suppression” comes in the wake of a controversial remark by Pennsylvania Democrat Congressman John Murtha of Johnstown in Western Pennsylvania in which Murtha painted his own constituents as racist, telling the Pittsburgh Post-Gazette in an interview that “There is no question that western Pennsylvania is a racist area.” Murtha later apologized.

Are we clear on all this? The state that chose Hillary Clinton over Obama in the Democratic primary is filled with racists because those same voters may actually vote for John McCain. So the answer is to flood the voter rolls with fraudulent voters who are “people of color” who may or may not live at any assortment of vacant lots and empty buildings yet have somehow registered dozens of times.

And the answer from Governor Rendell?

Hey! No problem!!!!

The grinding lament of voter suppression has begun. Sorry, if you can't run your organization in a legal manner (year after year) you're going to invite an investigation and scrutiny.

As a life long democrat, I must say that Voter scandals just makes me mad. This illegal scam by Acorn should be denounced by all parties, and should be rectified ASAP. If the FBI has to drag their asses to jail than so be it. And if they are thrown in jail that they should be given a minimum of 12 years in prison, all voter apllications rejected, and a mandated photo id registration. I have a friend who lives in Puerto Rico who tells me that for a person who wants to participate in elections they must show a valid drivers license, or a valid gov issue ID, a valid birth certificate, and the name/phone of a neighbor. When all is done, that voter is issued a voter ID card with a photo of that person and a registration number. Both old and young are willing to go thru all this for the priviledge to vote. That's why PR has a 90% voter turn out at each elections. So my point is if Puerto Ricans can go thru all that just to vote than I see no reason why Americans can't be issued a photo ID. And it won't disenfranchise the poor or handicap.

Here's an underlying question: why aren't the liberals in uproar about the ACORN issue? (Jim at #2 excluded)

Answer: the ends justify the means. Liberals know conservatives don't generally commit voter fraud, so they know that whatever gets through is good for their tally. So it comes down to Obama at all costs. Despite that the integrity of the electoral process goes down the toilet? Classic voter suppression arguments are now antiquated. Voter suppression is now defined as registered voters who won't vote because they think their vote doesn't matter after dilution by the fraudulent votes. God help us all.

Finally, why the heck did Murtha apologize for heaving that insult against his constituents? He meant it. He believes it. He is insincere to apologize. And he dilutes his brand image. Keep true to your core, Murtha. Insult the troops, call your supporters racists.... You wouldn't be Murtha otherwise.

With so much Voter Fraud Claims, I would like to see the President use the power given him in the Constitution, and delay this election for 60 days until the FBI and other Enforcement Agency can properly investigate these claims. The people in Pennsylvania has been criticized by Obama "as in hard times they cling to their guns and Bible" and Obama wants to be their President! Then Murtha, one their Congressman says the citizens of Pennsylvania are racist. Pennsylvania People do not deserve to treated this way. They are hard working, God fearing people who are trying to make a living and survive in this world.

The US Supreme Court has given a green light to voter fraud across the USA by its decision in the Ohio case. Bush it too cowardly to have the Justice Dept. step in. Imagine if Obama controls the Dept. of Justice next January. ACORN will be given positions in the DOJ. But if McCain wins, the DOJ will be able to investigate the massive voter fraud that is going on in this election and bring indictments against ACORN, if he has the courage to do so.

Chris| 10.18.08 @ 1:08PM

Republicans try to steal the votes of Americans every election. They use caging all the time, Thank you Obama for not waiting till after the election to challenge the Bush Admin and the GOP, and investigate their use the justice department to fix this election. There may be less than 1% of the 1.3 mill voter resistraion forms that are fake. By the way it is only "Voter Fraud" if Mickey Mouse tries to vote!!! ACORN is required by law to turn in ALL cards taken, thats why they flag them as FAKE, why don't you guys look into the Republicans trying to take the votes of people who had their homes forclosed, how American of the GOP!!!

bob | 10.18.08 @ 3:19PM

the reason for regisrtation fraud is not so the fraudulant registerd voters can vote over and over its so that when the dems need more votes they can just stuff the ballot box with more votes and not have to worry about having more votes than registerd voters like they did in king county wa. in 2004

James M. Farrell| 10.18.08 @ 4:18PM

There's only one way Obama could lose the election because of racism. That would be if a lot of Democrats and "Independents" didn't vote for him because he's African-American. Republicans will vote for the Republican candidate regardless of what color he or she is. That leaves only non-Republicans as the game-changers for Obama! John Murtha has exposed a nasty little secret about some Democrats: they're racists. Thanks, John!!!

Dan| 10.18.08 @ 4:33PM

PA voter law states that first time voters have to show id at the polls. Thus if some bum registers "Mickey Mouse" as a new voter to rip off acorn then "Mickey Mouse" will still have to show id when he goes to vote. This is a obvious GOP attempt at voter supression. http://www.huffingtonpost.com/2008/10/15/gop-congressman-jokes-abo_n_134769.html "Cant trust the result of the election".... please.......

Eric Edwards| 10.19.08 @ 9:22PM

Dan, if there was no intent to commit a fraud why would ACORN even allow someone to submit a fraudulent registration? I know that at the voter registration drives on my college campus the people taking the registrations are required to get a valid ID from the people attempting to register, that way we don't have out of state students attempting to vote in the NC elections and there is no fraud involved. If college kids can figure that out and make it work, why can't a community organization such as ACORN do the same? Could it be that they WANT as many new registrations as possible, and they don't care what they have to do to get them?

And how is this an attempt at voter suppression? If the GOP is asking for more provisional ballots and is willing to accept them if the new registrations are indeed valid, how would anyone "lose" their vote? And how would that "suppress" the vote? If you are a valid voter, whay would the fact that ACORN has been sued for attempting to commit voter fraud keep you from showing up on election day?

And a link to HuffPo as some kind of credible source of information...please...

Tom| 10.20.08 @ 12:57PM

Please...voter suppression? Come on...how is challenging proven fraudelent registrations and demanding ID voter suppression...it only suppresses FRAUDULENT votes. Get a life all you out there who think the GOPs attempt to ensure a fair election is some type of suppression.

OCPatriot| 10.20.08 @ 4:33PM

There's only one thing this suit has overlooked. ACORN gathers names of potential voters and submits them to the state. Got that? It doesn't register voters. Got that? The state registers voters? Got that. In many states ACORN must submit all names gathered by their employees. Got that? The state must verify the voters. Got that? So it sounds to me as if this law suit and the complaint you seem to have is that too many people (of color) have been submitted by ACORN and they maybe will vote for Obama as opposed for a Republican, namely McCain. Please list, if you will, how many proven fraudulent voters, and cite references for them, have been uncovered in this election thus far, and what is the evidence that this fraud has been perpetrated. I call this hidden racist propaganda, designed to try to counter the fact that Obama, and such organizations as ACORN, have been trying to find a way to stop the legal registering of new Democratic voters.

OCPatriot| 10.20.08 @ 4:37PM

Sorry, my last line got garbled. It should read, "I call this hidden racist propaganda, designed to try to counter, and invalidate, the fact that Obama, and such organizations as ACORN, have been legally registering thousands of new Democratic voters."

Donutwarrior| 10.21.08 @ 8:55AM

Ohio allowed same day registration and voting. Lets say you were an enthuastic Obama supporter who felt compelled to drive to Ohio and vote, got that? You then registered at an Ohio address and voted, got that? Tell me how the vote will be thrown out? That would be "suppressing" votes, and I will bet money it won't be invalidated until after the election, if ever. 105% of Indianapolis eligible voters are registered, got that? Fraud is now a given, and I no longer trust the electoral system. Got that?

WillofLa | 10.22.08 @ 12:26AM

Why doesn't the GOP people come right back and explain to the people of Penn. that, "No, it's not voter suppression, it's called fraud. Do you want Obama to win legally, or do you want your Democratic Party to fool you into thinking that Obama was good enough, as you believe he is, to have won fair and square? Or do you want to live a lie for the next four years wondering if he did win? Which is it going to be Penn. fair or fraud?" When are Republicans, not neccessariy going to "fight back", but rather just tell the truth about Democrats and how they win elections these days. If the Democrats supporters are actually buying the message of the Democratic Party, then let them show it by legally registering "people of color" who know how to find their way to their polls and understand how to pull the lever. And I'm sick and tired of the lack of the truth being told about the fact that the new "poor class" of voter the Democrats are bringing in to our country are not Blacks, but rather Mexicans. All these people the Democrats are declaring need their "universal health care" are not all those living in the country, but the ones who don't need it are those of us who are "citizens" of this nation. If the Democrats are so easy to figure out why don't the Republicans always blowing the whistle on them. Instead all we get from them is their going along with the Democrats and hiding in the dark corners to keep from being accused of being "racist" by the Democrats who are bigger racist than anyone. They discriminate against Christians, conservatives, non-liberal Republicans, ordinary joe the plumbers who may not need a license to perform their job everyday because the law allows their boss to sign off on all the work, and people from Alaska who enjoy hunting, horse back riding, and standing up against big oil. The Democrats are also racist against Jewish people more than the Islamist who flew jets into the Twin Towers by blaming it on Bush, and our soldiers are discriminated against by the Democrats to especially when they do their job in killing our enemies, fighting a war that the Democrats have declared illegal. And the Democrats are racist against Iraqi people to because the Democrats are the one's who said that the Iraqi's were to backward to become a free and democratic people. Now, what were all the liberals saying about Republicans for the past seven plus years? Is it all they had on the Republicans was 9-11, Abu Grab, GETMO, and Haditha? Gee, isn't all that things that have to do with keeping terrorists over in the war instead of having them come over here? Which side is Obama on? He's on the side of Saul Alinsky, Bill Ayers, Rev. Wright, George Soros, Jessey Jackson, Father Flager. Aren't all those people hate the same people and ideologies as the Democratic Party? Now, who are the racists again?
